It's disgusting how many people I see doing this on a daily basis.... god forbid one of their children got hit by an oblivious driver, I wonder if they'd change their criminal behavior then... Probably not.
Last June, I got rear-ended on I-95 while in a dead stop in rush hour traffic. The guy that hit me was texting and hit me going 50-55 MPH. I was pushed from the middle lane, THROUGH the fast lane, and into the guard rail. Then the scumbag tried to take off and run but his truck's front end was demolished. I thought long and hard about knocking him out as I was walking up to him but decided instead to go down the more legal, non-assault and battery road.

When I saw the pic that was my first thought. She fell asleep at the wheel or was distracted by her electronic device.

I wish I could say I've never emailed/texted and been driving at the same time but I'd be lying. Even using voice dictation which provides text to email/txts is a distraction. It's selfish, reckless and 99.9% of the time completely unnecessary.

In an accident like that, the driver is either distracted or incapacitated. Not trying to start a rumor, but she may have been looking down at her phone.
I don't think there's any call to go there yet. You might be right, you might not, but distractions don't just come in cell phone flavors. She could have simply been tired and zoned out for a second at a bad time. I've done that before when I was working nights, nearly went off the road a couple times over it, and not a drop of liquor in me or a cell phone on my person at the time.

Hence why I said "distracted or incapacitated". That kind of crash usually calls for one or the other. My bet was a distraction. Yours appears to be of the incapacitated variety since what you describe is essentially microsleep.

It only took me one really close call to simply put the phone down. I don't text or look things up at all. I do have a car equipped with voice-enabled Bluetooth, though, which makes talking on it easier and a lot less distracting. So I'll talk to someone on the phone but texts and e-mails have to wait until I'm out of the car.

Wow this is bad, she rear ended that Ford Escape and that fellow died. Then her car flipped into a pond where she was stuck upside down in the water in hardtop convertible Lexus. Wonder if the Ford broke down in the road and she just hit it. Wow, any second your world can change. feel bad for everyone involved.

Looks like she went...All. The. Way. Into the pond.

Thank God you were not seriously hurt. It is horrible how many people are on their phones while driving. Here in NH we have to be hands-free, and I guess that helps a little as you are able to keep your eyes on the road and your hands on the wheel, but I have also read stories that it doesn't help that much if you are focused on a conversation. The best thing of course, would be to ban all cell phone use while driving, but we've all become so used to doing it.

Saw this earlier. Such sad news. Prayers for him and his family.

Why is it always someone over 80 causing these fatal accidents. Awful

Those automated breaking systems will end up saving many people in situations like this. I get scared when traffic stops unexpectedly. Been rear ended by a driver I saw coming the whole way when that happened. She got out and yelled at me because I was stopped as were all the cars in front of me so someone 5 cars ahead could turn left into a driveway. I asked the police to cite her for phone use as I saw it but they would not.

Very sad my condolences to Mr Berman he's a favorite of mine on BSPN.

Sad sad news, I know few weeks back WWE icon Jim Ross wife was in a motorcycle accident and passed, this shows you need to be extra careful when driving, put the phone down and just pay attention to the road and the surroundings. Life is too precious. My condolences to Berman and his family.

That's a shame. In my case, they pulled the guy's phone records at the time of the accident. That's how I know he was texting. With the way he hit me (traffic was at a dead stop), he either had to be drunk or texting. In that case he was texting. It's funny because I quit smoking years ago, but he pulled out a pack of cigarettes and I made him give me one. I piped that thing down, hands shaking and my eyes as wide as dinner plates. Adrenaline is serious stuff. The doctor theorized that I would have been much more injured (possibly dead) than I was had I saw him coming and had time to "stiffen up". But, because I didn't see him coming, I was loose and all I got out of it was a herniated L4/L5 and a dislocated shoulder with a partially torn labrum. To this day, I feel very fortunate.

I was rear-ended in stopped traffic on an interstate by a guy on his phone. Of course he denied usig his phone and said that he was slow to react "because I had something in my eye".

Either way it was his fault, but... PEOPLE... PUT THE PHONE AWAY AND DRIVE!

Not saying that was the cause here, and I feel awful for the victims and their families!

It is, and I can be guilty of that at times, as well. It is not often, but only takes one time. Terrible to hear about Chris' wife.

I hate when I see people do that. And I hate myself even more when I do it. It's just so tempting.
