Is emailing ....."helmets that can pass as game used" ....really a smoking gun?
If he wrote......."helmets that qualify as game used" .....there would be no issue.
Sure, there is room for interpretation, but Manning's lawyer should be able to spin the word "pass" as a directive to find game used helmets.
"Pass a class" means you satisfied requirements of the course. Same can be argued here.
On another note....back in the day, I worked with someone whose relative was journeyman MLB player who earned a World Series ring one season. My coworker was asked to see if he could get a team signed baseball from his relative to sell at a big charity auction. The player forgets to get the baseball, so the day before the auction, the player brings a clean baseball and a sharpie to a gathering of friends who take turns forging players names. This ball sold for $2700.
Another interesting note regarding this MLB player. Again years ago.....just before the season McGuire and Sosa were gunning for HR records and steroids had yet to reach the public's conscience, I was at a Spring training game watching the Saux with the relative of the MLB player. As the Saux lined up on the first base line during the National Anthem, the contrast in body size/shape between the MLB vets and minor league hopefuls was glaring. We discussed this topic and the relative of the MLB journeyman (who played on 7 MLB teams) rattled off a list of a dozen MLB superstars of that era and said it was common knowledge within the baseball community who was juicing. Years later, 11 of the 12 players listed by my coworker were outed in the fallout including Bonds, Sosa, McGuire, Clemons. Only one player on his list slipped past the scrutiny during the scandal era....and this player happened to play in NY. Coincidence? I'll let you guess the name but know his statue is in the HOF.
The best stories this MLB player spun to his relative had to do with all the tail the players had thrown at them on road trips....but I digress.
One last one......to illustrate the difference between the cutthroat NFL and the clubby/insulated MLB. This player was out of baseball with no prospects of ever playing again....one week short in service time to qualify for a full pension. During the offseason, he gets a call from a journeyman MLB manager who he was close with.....the manager was just hired by a garbage team and this manager pushed hard to get this player signed....with the secret intention of getting the player enough service time to be fully vested. Mission accomplished....and the player was released soon after.
