went back and took a look at this particular issue...
Apparently, prior to the 2006 CBA, Teams could indeed bury players on the bench or whatever / deactivate them for as long as they wanted... That was upheld in 2005 by an arbitration ruling in Terrell Owens / Philthydelpia Iggles squabble... In the 2006 CBA, as you stated & which is why they mention the 2006 CBA i guess (though, just saying 42-1-xvii in the the current CBA would work and be more correct) the rule expressly prohibits teams from burying players for more than 4 weeks specifically due to conduct detrimental ... " The Non-Injury Grievance Arbitrator’s decision in Terrell Owens (Nov. 23, 2005) is thus expressly overruled as to any Club decision to deactivate a player in response to the player’s conduct." (2020 CBA § 42-1-??) ...
Man that ruling really pissed off the players if they got that included in the CBA the very next year lol...
While I think that it would get overruled, there might be some wiggle room for the Browns here because of technicalities, because both the team and the player agreed to the circumstances at hand, that there was no formal suspension etc etc ad nauseum...
