One important thing pre-nups do which most people don't realize is that they determine who gets jurisdiction in case of divorce. In Brady's case this is especially important. You have an American man marrying a Brazilian woman two times, one ceremony in California (his home) and the other in Costa Rica (her home). I do not know which ceremony came first. Then they live about 10 years in Massachusetts but also spend time in NY (and elsewhere) and eventually move to Florida.I mean this comes with the territory of wealthy marriages.
Absent a pre-nup, the simple act of setting jurisdiction in the above case could be a logistical nightmare. Which country's laws apply? Which state's laws apply? Where are the divorce proceedings held? etc, etc....
