I agree that it is going well so far, but would just caution that they are questioning the NFL's attorney at the moment. They will be tough on Brady's counsel too. Nevertheless, they have definitely seized on the inherent unfairness and lack of process the NFL used here, which bodes well IMO.

Not neccessarily. Or at least not nearly as hard. Judge Berman destroyed the NFL in the hearings and went fairly light on Brady.
 
First question makes sense, Chin appeared to be the most liberal of the three judges.

Don't particularly like Katzmann's question because the fact-finding of the arbitrator is supposed to be beyond scope per my understanding. Unless they actually are considering to rule on what Berman didn't (impartiality).

It speaks to the NFL not following process.
 
The NFL is getting hammered with the questioning. It will be interesting to see if Kessler gets the same treatment.


Kessler isn't the attorney, Steffen Johnson is.
 
Based on the perceived tone of that questioning...I think the federal judges are pretty pissed that this nonsense is in their court wasting time.

i think kessler's making the argument because of his familiarity with all the case law.

A good follow up question to that would be, "can you give some explanation as to why he found Brady's testimony not credible? Other than bias of course . . . " "Did he contradict himself? Was it inconsistent with some other evidence?"

Parker calls Brady "one of the most celebrated athletes in the game." But he suggests that this may argue in favor of punishment.

I don't follow that logic at all. The rules apply differently to different players based on how good they are? By that reasoning, Brady should have been suspended forever!

Iam surprised they didnt ask why pash was made unavailable as that was one of the points by berman
 
It sounds to me like the entire arguments are making an assumption of guilt of deflating footballs. I think Berman had ruled from the same point of view.
