They don't need to be punished by the NFL or NE for it to be "injurious". Losing endorsements would suffice.

But the bigger problem is that for public figures proving it false is not sufficient. The plaintiff needs to prove that the utterer knew it was false or that the utterer uttered it with a reckless disregard of whether or not it was false. That turns out to be a pretty high bar in practice.

In this age of technology, it's very likely there is evidence on emails and phones of the intent.

What Kraft should have done in 2008, was not sue the Herald, but demand Tomase be fired.

That would have AT LEAST put them on notice, and it would had some effect. But, this business of this being a huge moneymaker for clicks over the past 10 years, would have changed the industry if he did sue.

Deflategate never would have happened, for example. ESPN would have been fearful of printing what they did until the whole thing was understood.

Agree. It really is the WEEI producers and programming wonks that provide these hack trolls with the platform. They want the audience to be pissed and angry so they listen and call in.

I don't think it's anything diabolical. I think it's self serving. He knows nationally everyone hates the Pats. He's looking to make a name for himself. Hot takes during Super Bowl weeks = clicks.

It's clear the Skins don't think he is. I am not saying they know what they're doing, but when Minny, NYJs, Denver, etc, all start bidding on Cousins, all of those teams' cap positions will immediately be destroyed.

Denver is rebuilding and they refuse to acknowledge it. Minny should consider resigning Keenum, but at a price of about 16/17 mil only. Nothing more than that.

If not, use Bridgewater and hit the draft.

Right, but knowledge of knowing something was wrong, but still selling it in print is the intent to do harm.

I believe stuff like this would be all over computers and phones, even with Goodell, some owners, etc.

If Brady had sued, it would have likely brought the entire league to its knees.
