Dennard arrested for DUI

I respect your postion/view on it, but disagree in some regards. Person goes out and has 2 beers while waiting a 1/2 for a dinner table. That person then has 2 glasses of wine while eating dinner over the course on another 1 1/2 hours.

That's 4 drinks in 2 hours. Would it be drunk driving for them to drive home right then ? Does it depend on other factors such as what they had eaten previously in the day ? Or a person's metabolism? Or their weight? Or the level of body fat?

At this point, unless a person has made the decision to never drive after having anything to drink, then they have to use their judgment to determine whether or not they can drive safely (and legally). As noted previously, consumption of alcohol impairs your judgment.

I hear you, but I just can't agree. You are using a weird form of circular logic. Since the alcohol impaired their judgement, we can't hold them responsible for knowing whether they drank too much.

You can't use the very thing they mismanaged as a reason why it was OK that they made a bad decision. Again, I can understand and even empathize with it, I just don't think it reduces liability in the least.
 
I seriously hope the Pats don't cut this guy. He'd get scooped up in a minute unless the NFL bans him for awhile. He's probably one of the best cb's we've had in years.
 
Being released after two arrests in subsequent years? Sure there is.

Anybody can be arrested, it only matters if he is convicted. If you wanted to argue that if he is convicted for DUI then he should be released that's a different conversation. I still wouldn't agree but a different conversation just the same.

Dennard was pulled over for straddling a line, did he cross over a lane? Nope just to close to a line in the cops opinion. The jury will laugh this case out of court. He was pulled over for being a black kid driving at night, harassed because he punched one of their own in the face.

He did not fail a breathalyzer he simply refused to take one. Considering the circumstance of the fact he just got 30 days in jail for punching a cop he didn't even know was a cop in that city I would probably refuse it to, not going to trust those same people submit a accurate result to the courts. That's a joke.

I'll pay attention to this story when the reporting is clear as to his blood alcohol level. If it's above the legal limit, he's screwed, because he's on probation for a related kind of offense. (Partying so hard that there was an after-effect when he left the party premises.)

If he's below the limit, then it's a fortunate wake-up call/narrow escape shining light on Dennard's dubious lifestyle choices.

No they cannot force that without a warrant from a judge.

And based on the fact they made no mention of Dennard failing the field sobriety test in the report I'd be curious to what the probable cause would even be to detain him and ask for the testing.

Second year player coming off of a trial where he was charged with assault on a police officer, gets probation, and subsequently gets a DUI. How much do you think the team could get for him in a trade? It makes more sense that he gets cut, if any reprucussions were to come down from the team on this.

I haven't read every comment, so I hope I'm not re-making this point, but:

Some folks say we can't cut him, and cite the roster.

The implicit assumption -- usually a pretty good one -- is if cutting a guy makes us lose, we can't do it.

Thing is whether Kraft and/or BB decide to lay down the law, and I don't mean Ty, and I don't mean Lawyer, and I don't mean the law firm, all of whom have been laid down already.

What I mean is, they might get to the point where it's an "enough is enough" moment, if it's what it very much looks like it is (hence the slippery "awaiting more information" clause.)

Not saying they will come to this conclusion, but if they do, what they're really saying is, "Know what? Sometimes you lose. Sometimes you have to to reign in the thug factor."

Sucks to lose a year in the remaining "Brady Window," which is 1 - 5 years, realistically, and that's giving him a really lengthy stay atop the mountain.

But if they do decide to lay down the law, it's completely justified. As others have said here -- DUI, on probation? Maybe some other year. Maybe even some other month in this year. Not this month in this year. I can back 'em 100% if that's the outcome.

Part of me hopes I don't have to... and actually, part of me hopes I do.

Why? Because our dumb ass ex-TE may have murdered some people? Drinking and enjoying their lives in the offseason shouldn't be taken off the list. Making bad decisions after that (like getting in a car and driving in a state where you were just on trial for assaulting a cop) SHOULD be taken off the list.

Drunkenness clouds judgment often leading to bad decisions and inviting trouble, especially in public. These guys are in the spotlight wherever they go and don't enjoy the luxury of carousing anonymously -- just one price of fame and fortune. I'm not saying they shouldn't go out and enjoy themselves, just keep it under control.

It should also be noted that refusing the breathalyzer is probably the smartest thing that one can do in a D.U.I. situation as well.

Doesn't matter, if he passed the field sobriety test. Straddling the lines. That's laughable. And people want to cut him.

DUI isn't exactly killing someone.

If he is let go, he will be a starter on some other team. I wouldn't release him.

I doubt the cop was able to tell whether he was black or white at 2 AM. This is a lame excuse and I thought you were better than this.

I'm normally am but honestly I think this kid is being harnessed in that city unfairly. He got 30 days for hitting a cop who didn't even present himself as a cop, now he gets pulled over for straddling lines and then cited with a DUI without any mention of failing a field sobriety test.

For what it's worth I'm a white Jewish man so I'm not going MLK, I'm just saying this situation doesn't seem fair, it could be race, could be age, could be jealousy over money/fame or it could be that he hit the cop. But if he didn't fail the field sobriety test he had no reason to be taken into custody.
 
The guy is on probation for assaulting an officer. He refused a sobriety test. How many chances should he get? And, yes while the Ahern thing is going on. I think the writing is on the wall. He's toast.

In all fairness - the fact that he was pulled over in the same city where he assaulted the officer does raise the question of whether one can assume ANY officer in that city is unbiased when it comes to Dennard.

It wouldn't even surprise me if they knew his vehicle and licence plate. These guys aren't exactly the forgive and forget type.

So as much as I like to send a strong message, in this case I'd prefer that we see what comes of this case first.
