Hate to be a spoilsport, but circumstantial evidence can be enough to convict. Not saying there's enough of it in this instance, but this exuberance over lack of direct evidence is irrational. Expected better of Steph Stradley. The NFL's case has always been built on inference and lack of direct evidence has been known for quite awhile.
True. But each position has 2-3 paths (for simplification). A) Puts Brady in a positive light, B) the truth, C) Puts Brady in the negative. Now, it could be that the truth falls under A or C, but we don't have all the relevant info available.

Let's say there are 5-10 inferences made by the NFL. Pretty much each and every one went with (C) only. And even then, their case is extremely weak.
 
Preseason game. I hope Brady chooses to attend. If it makes the odds of a ruling in his favor 2% more likely, it's worth it.

Agree. I have the feeling that Yee's advice hasn't been the most efficacious to TFB's cause. I hope Kessler urges strongly that he attend. Downside, he loses out on effective practice in pre-season game 2. Upside he has another (3rd) game to tune up and may as a result of appearance boost his odds of playing games 1-4 where it counts.

Unlike many fanboys here I am not jacked & pumped to see JAG at QB for games 1-4.

i've been saying this all along. yee's representation in this matter has not been stellar. kessler should have been brought in from the start. yee is not a practicing litigator - he's an agent. all he does is negotiates contracts.

Perhaps Yee's "bad advice" was part of an overall strategy that the legal team is employing. Sort of a "good lawyer/bad lawyer" tactic that gives grounds for a settlement without a suspension.

Yup, if you cannot demonstrate a crime was committed - or worse, evidence suggests it didn't happen - no amount of circumstantial evidence is sufficient to conclude guilt. Wells appears at least smart enough to understand this, which explains his blatant massaging of the assumptions for Exponent's calculations.

Totally agree. My only point was that this was not a new revelation, although I guess it may have been to those who had not been following closely.

He doesn't want the NFL lackeys to get an early start to their weekend. then again, probably be better to be on Berman's good side and file early.

But the NFL has moved the goalpost on what the actual offense is. Deflated balls are not the issue, it is now the lack of cooperation and destroying a phone. RG is trying to have it both ways with the Wells report. He claims its the basis for all his decisions but then ignores where it states how co-operative the Pats and TB actually were.

In any event, the court will rule based on facts and not check the latest ESPN poll to see if TB is guilty. The NFL is toast and they know it. If they thought they had any chance they would at least appear to compromise a bit. They are acting like a squad of surrounded Japanese soldiers on Iwo Jima. They could surrender, hold out longer or charge the machine guns waving their swords and screaming. I can just hear Kensil in the conference room screaming "Banzai!!"
 
I was hoping to wake up to it this morning. I really hope its still coming out today. Im sure its going to be really juicy.
Hopefully Kessler has aquired some new, damaging information.
 
Id be happy with him just directly pointing out the absurdity in the NFLs arguments.

Last filing, they both filed within minutes of each other. I think there was some sort of professional curtesy agreement between the lawyers. Suspect they'll do the same today.

IIRC, that came from Kessler, or a "source close to".

I don't understand what he'd gain from lying.

Thats what i thought. i think it was in one of the tweets that brown put up that kessler told berman he was going to file something on friday.
 
the filings won't be done until closer to midnight - it gives the NFL less of an opportunity to sneak in a counterargument to something kessler brings up
