Reading this is worse than reading a game thread!

All said if I understand the judges' remarks correctly suddenly invoking the mis-alleged facts (sic) of the occurrence, I am glad that I never wasted my time reading the pages of legal analysis posted here.

Clement's argument was that the inflation levels affect every single offensive play, so it's a huge factor.

Berman found: (1) Goodell denied Brady equal access to investigative files; (2) Brady had inadequate notice of the potential penalties; (3) that Brady had no notice that what he allegedly did constituted an infraction; and (4) that Goodell improperly denied Brady the right to cross examine Pash.

Berman specifically did not address: (1) evident partiality (in short, Goodell designating too much authority to Vincent); (2) that Goodell's grounds for punishment were not factual findings from the Wells Report, but rather, after the fact conclusions reached by Goodell and Goodell alone; and (3) Goodell was bound by the Wells Report and couldn't veer from it to Brady's detriment.

I may have missed something, but that's what I recall.

Which makes me wonder why Chin would make such a damaging statement of no relevance to the appeal. Seems highly irresponsible.

And if Chin writes the judgment, how likely is he to commit a complete 180 from his expressed opinion? "As I initially reviewed the evidence in a negligent manner, without a critical eye if you will, I now realize the Wells' report was in fact fraudulent and contrary to simple established science, and in fact good for nothing other than to bolster the NFL's predetermined conclusion."??

Edit: I have not been following the appeal that closely, and what I wrote was knee-jerk, so I could be wrong to varying degrees on multiple levels in this post.

that would lend itself to the court casually upholding Berman's ruling.......I think it would not be as casual if they were overturning

I honestly feel SLIGHTLY better after reading this tweet.

Why is everyone, even legal analysis jumping ship? These are not Jets fans in a local Pizza shop. These are FEDERAL JUDGES. They're can't be THAT stupid.

Seems to me like they were testing both sides, trying to get one of them to crack. Kessler's side won, why would he not be grilled hard? But you can read the the questions to the NFL side and think they were backhanded.

They went hard after both sides. But the point to me remains, this isn't about whether or not Brady threw away his phone (where the NFL got all the pertinent info anyway, but hey, who needs logic), it's about the due process. So they judges can think there was an illegal, shady, backroom, ball deflation scheme going on, but it doesn't change the facts that they found no evidence and Goodell over stepped his bounds.

I agree with your sentiment.

Yet, I am not surprised by such verbiage from a judge.

I remember reading a book by former prosecutor/attorney Vince Bugliosi, and he summed up judges as, and I am paraphrasing here, basically a hybrid between a lawyer and a politician. Two professions that each have a negative connotation in our culture, yet once they put on that black robe, they instantly become these paragons of virtue or something...

(I am sure there are plenty of respectable judges out there, but as with every profession, there are a lot of incompetents as well. )

The most likely thing is that they had a decision already rendered before entering the courtroom........which is why they were so 'casual'
