Right now my speculation says there is a 1 in 3 chance that he is the killer but who knows, Casey Anthony could be involved so I guess that makes 4

In a court of public opinion it may have been better to come out and claim his innocence. But in a court of law, it can do nothing but hurt him. The police aren't going to stop investigating him because he went in front of the cameras and said he is innocent. Anything he says to the press can be used against him in a court of law.

Innocent or guilty, the smart move for Hernandez is to shut up and not talk to anyone until his lawyer negotiates a deal with the police and DA so that anything he says doesn't get him in more hot water.

I'd agree with you that not saying anything is the right move if he was involved in the murder or knows what happened, but if he is innocent then I disagree.

How could it hurt him in court if he truly is innocent? If he's innocent he should tell the police he's innocent and knows nothing, he should tell the public he is innocent and knows nothing, and if he ends up in court he should tell the court he is innocent and knows nothing. I can understand the first day when the cops knocked on his door for him to say he wants his lawyers present, but now this is 5 days in and he still hasn't said a word? If knows nothing about the murder it would help him more then hurt him right now to say so.

not saying anything whether he's guilty or not is ALWAYS the right move...ask any lawyer. He deferred to his lawyers from day one...no matter how many unicorns and peter wabbits with daffodils you pull out of your posterior the TRUTH is he will talk to the police WHEN his lawyers deem it appropriate. PERIOD. Why do guys like you NOT get this?..and it's SIX days in going on 7....invest thirty cents in a calendar.

Its easy to say that, but you aren't in his shoes, and don't know the circumstances.
There are many possible factors even if HE feels he is innocent. He could have been there, as an innocent bystander. It is incredulous to think that an innocent bystander shouldn't be fearful of being falsely accused.
His lawyers seem to disagree with you and they know his version of what happened and are trained to make these decisions.
I understand that to Patsfans its a crime to make us wonder what happened, but Hernandez has a lot more to worry about that fans impatience.

Because innocent people aren't always acquitted. . . .

And, as others have noted, there's Jetdell to deal with. The less said in public, the less he potentially has to answer for.

Roughly 30 minutes long but it's interesting - a Law professor and a cop debate why you should always employ your right to remain silent - even when you "have nothing to hide."

Granted holding a press conference or calling the victim's family aren't the same as talking to the cops but there are still landmines.

A better question is - what can it help? The court of public opinion means **** all since at worst he will lose his endorsements and possibly be banned from the NFL and lose millions. On the other hand his freedom is at stake.

Helicopter follows him taking left and right turns as well as filling up his car with gas.

Friday: (morning) Police issue arrest warrant for Hernandez. O wait, they didn't yet.
(afternoon) Police may will could issue arrest warrant for Hernandez, just not today.

Saturday: Police will arrest Hernandez, o wait, not today.
Cops go to Hernandez house. Leave with bags; he has a nice doghouse.

Today: Nothing

I'm with Tunescribe, this is just annoying and drawn out.

Oh my aching head.

Let's put this into football terms in an attempt to make it easier. You know how Bill Belichick doesn't really answer the questions during his press conference? He skirts around but really doesn't provide a sound explanation. He does this because he doesn't want to give the other teams any information that can be used against him (and the team). These press conferences are mandated by the NFL, otherwise it's a safe bet to assume BB would not talk at all. Agreed?

In the legal system with the 5th amendment AH is not obligated to talk to the police, let alone be foolish enough to hold a press conference. We all know AH may not be the smartest guy in the world, but he's smart enough to listen to his lawyer and keep his mouth shut. If AH chose not to listen to the sound advice of his lawyer to say even a few words, or call the parents of the victim. Odds are good his attorney would tell him to go find another lawyer. Why? Because it can NOT help and can possible hurt.

For the record, I'm not trying to compare a football game to the seriousness of a person losing their life. Just attempting to end the madness with the "why doesn't he talk to the police" crowd.

Ask the thousands of innocent people who have been convicted of major crimes because they decided to speak to the police and/or the press because they were innocent.

Anything he says can be used against him. He claims he is innocent to the press and half the people say BS anyway.

OJ told the press he was innocent. He practically screamed it at the top of his lungs. Do you believe him?

What do you expect him to gain by saying this? If the police think he is related to the crime, then they're not going to call off the investigation just because he says he didn't do it. They could just assume right now that he claims to have no role in the murder. Him telling them so wouldn't change anything.

Yeah, I don't get it? Are people going to say, "I thought he was guilty when I heard he smashed his video equipment in his house and his telephone, but since he said he was innocent on his front lawn to a bunch of reports, he has got to be innocent. Why would he say he was innocent if he didn't."

He has nothing to gain by declaring his innocence to the press. If he did, I am sure then people would be picking apart clips of him declaring his innocence like because he didn't look directly into the camera means he has something to hide or he looked down when he claimed he didn't kill his friend which means he is guilty.

Yup...Ahern prominently displayed smiling...in his Patriots uniform...right next to "Murder in North Attleboro" in block letters...many people are schooled in the ways of modern media but that's called a grand slam to those who may have missed the jumping of the shark by the "objective news sources" around here the past twenty years...

I'm just surprised Mt. Vesuvidell hasn't begun rumbling , foreshadowing the inevitable fiery volcanic eruption...
 
Some famous people (or nationally followed cases) charged with murder or other serious crimes who declared their innocence to the press prior to trial (off the top of my head) either by themselves or their attorneys or both:

Charles Manson
Amy Smart
The Melendez brothers
OJ Simpson
Susan Smith(claimed her car was car jacked)
Charles Stuart (blamed an unidentified black man which sent Boston into a near race war)
Mike Tyson

So that shows that trying to go to the press to declare your innocence is not proof of innocence. In fact, it seems that guilty people are more inclined to go to the press to declare their innocence. Possibly as a last ditch effort to get people to believe them before the avalanche of evidence comes pouring in against them.

There hasn't been objective journalism in this country in decades. Everything is sensational at this point.
 
This line of thinking is very solid and is what I feel could be the real issue now; namely that they cannot concretely establish Hernandez's absence from the crime scene, which is sufficient cause for prosecution, I believe.

I was also just thinking that most of the people in charge of this investigation are also, more or less, Patriots fans (they are human too) and thereby are well aware that what they are going to do is most likely going to destroy what would have been a brilliant NFL career. I think that is one reason this thing has been so slow and deliberate.

I suspect you are right with one change, take out 'prosecution' in favor of 'continued investigation'. The prosecution side is another ballgame.

If evidence was hard enough for prosecutors to issue a warrant and begin prosecution, it likely would have happened already (though due to the high profile nature, they could be raising the bar higher).
Again since there has been no arrest, it's not unreasonable to guess evidence of guilt to a reasonable degree does not exist. This means the crime remains at the feet of law enforcement and further investigation, not prosecutors. And, my guess, if the search warrants executed have turned up little and any other alleged parties involved in the crime do not provide any hard evidence, the big story of 'AH the Murderer' will grow much less hot/pointed in the media and in the mind of the public. And while it will continue to be discussed here, it will taper off....and we can get back to talking about Gronk's 26 surgeries .
