Kaepernick ..... Tryout Edition

I never thought I would say this, but Stephen A Smith is dead on the money. Absolutely eviscerates Eric Reid.

Thank you, Colin Kaepernick for proving to everyone you are exactly what I said you are. A selfish player who doesn't deserve to be playing in the NFL.

The fact you wore a shirt with Kunta Kinte on it and likened yourself to him is laughable. You have ZERO idea what it was like to be a slave. You were raised by a loving white family and they put a silver spoon in your mouth from the day you walked through their door.

Just watched most of Kaepernick's workout.

Is there anything in that workout that would mean anything to an NFL team?

Longest throw was about 50-55 yards which is nothing special.

Best throw was a 40 yard touch pass down the left sideline that hit the receiver in stride.

But basically all that anyone could take away from it is that he can throw the ball 50 yards downfield. No real zip and no eye popping 70 yard bombs. Just generic warm-up routine stuff.

By the way those calves look like they haven't seen a weight room in years. Haha.

Isn't that what he asked for from the XFL?

Anyway his actions have demonstrated that he would rather be a paid social victim than a football player.
Propaganda from the NFL. NFL isn’t trustworthy.

Not sure what you can really take from it. Dwight Howard is a 90% free throw shooter in practice hah

Is anyone buying his **** after the stunt he pulled on the location of the workout? Wants a film crew for a documentary. Guys a ****ing fraud jerking people around, pretending to be some hero SJW...all he is another mouthpiece looking for a payout, playing a role in suckering people.

The guy is a piece of ****...hopefully this is the final chapter...but for some reason I doubt it is.

This whole thing was extremely weird. The drama that came with a BS workout is a harbinger of what any team who signs him would be getting in terms of distraction and unnecessary noise. Maybe a couple of years ago it would have been worth the distraction, THe scouts who saw him yesterday mostly voiced that while he has a strong arm, his accuracy and touch were not good.

Pats do not need another headache this year.

Stunning to me how all these Patriot fans in this thread trust the NFL on this.

And you're quoting nothing but lying NFL mouthpieces who to this day never defended Brady and Belichick. When you hear James Brown talk, you hear the NFL talk.

Several points I would make here:

1. Can't believe I'm listening to the media argue AGAINST media access. Unreal. The reasons for Kaepernick demanding media access are obvious. So that it would not be secretive.

2. According to Florio, the NFL's waiver contained language absolving the NFL of all future liability with respect to collusion: Inside the waiver proposed by the NFL to Colin Kaepernick

3. The scouts on hand think Kaepernick's movement, arm strength etc., is good enough to be an NFL backup.

Hard to believe the talking heads (who are paid indirectly by the NFL) are being taken seriously.

Kaepernick moved this for the two obvious reasons I mentioned above--as he should have--and he also showed that he deserves--and has always deserved--a shot at playing. If the NFL is keeping him out, it has been about his social activist stances. I'm not going to get into that--but anyone who says he wasn't justified in his actions this week, anyone who says he's not good enough, they are totally wrong.

In fact, why are we even arguing about his? Some owners have made it clear it's his social activism that has caused them to blackball him. This is all out in the open. It is known. There is no argument here.

I'm just stunned that Patriots fans are falling for the NFL's ridiculous framing.

Kaepernick > Goodell.

I don't trust either the NFL or Kaepernick. And there's humor watching both fraudulent high horse entities go at each other.

Can I say that it's just as stunning that you trust Kaepernick?

Trust him on what? What are you even taking about?

I quoted Florio. Not Kaepernick. Are you saying Florio made that up?

Ok. Not worth discussing. Games are on.

Kaepernick supporters are going to have to step back and do some soul searching. Even Florio, who's been leading the SJW charge on this, has had to pull back on his rhetoric. Not only that, but his "But, maybe...." is weak sauce.

Inside the waiver proposed by the NFL to Colin Kaepernick

Now, there may have been other problems, but there's no way that the quoted portions of the waiver should have been one of them. This portion of his writing

The phrase “directly or indirectly” should raise a bright red flag, because the term “indirectly” easily could be used to bootstrap a waiver intended to protect the NFL and all related parties against a personal injury lawsuit into a silver bullet that would defeat from the get go any claims for collusion or retaliation related to Kaepernick’s ongoing unemployment from the moment his February settlement agreement was signed through and beyond the November 16 workout.

is nonsense, as the fuller statement quote makes clear

related directly or indirectly to the Workout, Player’s presence at the Facility, and any medical treatment or services rendered in connection with or necessitated by Player’s participation in the Workout.

That's not a surrendering of a lawsuit over 3 years of alleged collusion because of a single workout at the end of that time period. The NFL would have to acknowledge collusion issues just to TRY tying the two together, and that would be deadly to any defense. "Are you saying that he was given the tryout in order to make up for 3 years of collusion? Is that why you're claiming a direct/indirect relationship here?" would pretty much be the end of the NFL's chances to win any such case.

But, even if the attorneys decided not to take the chance of signing with that there, in an abundance of caution, looking at the portions of the waiver agreement that Florio chose to make public, there's no reason why Kaepernick could not have just requested a one line addition stating stuff from the past (i.e. 3 years of alleged collusion) isn't precluded because of this workout*. Had he done that, publicly and prior to 2:30 pm on the day of the workout, his defenders might have had a case, and the NFL would have, at a minimum, been put in a defensive position. The way he did it, however, shuts that notion down.

*This doesn't mean that Florio didn't miss anything else. I'm just talking about what he's posted and commented on.

Even if you think cop and troop worship culture is gross (I do, obviously), there's no real reason to see Kaepernick as a hill worth dying on. That said, purely from a labor perspective, he's absolutely right not to sign a waiver of right to sue. That's insane.

Waivers are signed all the time. The issue here is the claim that the waiver wasn't standard, not that it existed.

Non-standard waiver preventing Kaepernick for suing in the future. Kaepernick is forthright in saying he would have signed a document absolving the NFL in case of injury, etc. He was not about to sign away his future rights.

According to Florio, the NFL's waiver contained language absolving the NFL of all future liability with respect to collusion

That’s not what he said. This is Florio’s quote about the language: “Most of that word paella has become standard practice”

It was a standard waiver, and the language has nothing about collusion or his ability to have a lawsuit. Read it yourself. I’m still looking for an explanation on why he had the waiver for three days and didn’t object to the language until just before his workout.

If the NFL is keeping him out, it has been about his social activist stances.

The “NFL” doesn’t hire players, teams do. If the “NFL” is keeping him out then they would have to be going around calling and emailing teams telling them they can’t hire Kaepernick. And of course no team would have to listen to them anyway since the NFL can’t stop them from hiring him unless they suspend him- which they can’t and won’t do. Not only would they have to have done that, but they would have had to have done it in the last 8 months when they know he likes to litigate.

Some owners have made it clear it's his social activism that has caused them to blackball him.

That’s exactly why collusion doesn’t make sense. Teams already don’t want to hire him, no collusion from the NFL is required to explain his unemployment. He’s not the first or last player to put himself in this situation.

The NFL will have to get rid of it's federal status for this argument to hold because in the eyes of the law, they are not individual businesses, they are a collective, and they have a waiver to that effect.

As for Florio's article, he doesn't say it is a standard waiver. He says the opposite. The operative word in the section you quoted it "most." Most of the language is standard. But NOT the section Florio highlighted. In that passage, Kaepernick would sign his future rights away. And as for the timing, his representatives said they came back to the NFL and asked to sign a standard waiver, which they were willing to do.

If I'm Kaepernick or his people, I take Florio's advice and refuse to sign, especially since the NFL is not to be trusted, especially on this issue. They are on the record as blackballing him. They've already settled with him on this issue.

Everything Kaepernick did yesterday points to the NFL's untrustworthiness on this issue, from past statements, to attempting to bar the media, to inserting non-standard language into the waiver.

Goodell is a weasel and not to be trusted.

Let me try again, since you must have misread my post.

Lol I would rather argue about politics than legal waivers.

In this case, they are overlapping one another, so you get both. That'll make your day brighter!

Lot of Goodell lovers on here (not referring to Deus and Bob)
