He asked belichick if the taping was against the rules and BB said it was.
I don't see how deciding it was futile [Jonathan Kraft's words] to beg the emperor for mercy in a league that is obviously fixed against the Patriots right now [see heated balls on TV with VP of officiating commenting on it's illegality but no punishment] is turning his back on the team.
If anything he had to swallow his pride to take a course with a chance of success [ditching goodell] over the popular route, which would be a loud, pointless appeal to Goodell as judge, jury and executioner, diffusing the impact of the NFLPA and Brady appeal and possible lawsuit that has a tremendous chance of success for Brady, and the players and could really screw up the league.
Besides an emotional venting, what purpose would an appeal to the guy who authorized the punishment in a fixed league, serve?
You don't think it's fixed, right?
Check this out about 2:45 with the host asking the VP of officiating Blandino...Now that's illegal. What are you guys going to do about that?
And, they were caught in the act on TV!

You would think that could be Exhibit A if Kraft hadn't quit on his team.
