If no charges are filed....what exactly do you base a suspension on?

Commish has the power to suspend any NFL player under the personal conduct policy regardless of whether charges have been filed. Remember that no charges were brought against Roethlisberger? Yeah. It's an absurdly broad policy, but it's in place and I'd expect the almost certain suspension is the least of AHern's worries right now.

The arrest warrant has not been issued, but has been prepared (according to reports, at least - believe what you will). I'd wager that prepping the warrant on the lesser charge is a way for prosecutors to lean on AHern to get him to talk....

Except for the fact that nothing that mentioned in the NFL Personal Conduct Policy mentions that the Pats can terminate his contract. I am pretty sure that can only be done if there was a morals clause in his contract.

Doesn't matter what you think of it, only matters what Roger thinks of it. There's enough bad press for Roger to warrant a suspension given that a large part of the PCP is to avoid bad press for the NFL. I'd wager that beyond the bad press there's enough bad judgment on AHern's part to also warrant suspension. The only way he doesn't get suspended is if he is somehow miraculously completely innocent of any wrongdoing, as unlikely as that seems. Again, getting suspended is the least of AHern's worries.
