It's more that there are different rules that apply to fumbles and muffs. The Patriots never fumbled the ball, only muffed it, so the rules that apply to fumbles would not have applied.
You are not allowed to intentionally muff the ball forward (it's called illegal batting), but none of the rules about who is allowed to advance the ball on a fumble apply.
