Actually the fact is exactly the opposite.
He was wiping down a machine from prior use, was getting ready to use it, and Pass wanted it and floored him, per the reported video.

I feel like this should have been resolved with security footage in 5 minutes.

Edit: Now that I've seen the video of Pass refusing to offer his version of events, it just reeks of lawyer advice when you have something to hide. What little he said is very ambiguous and doesn't come close to denying physical contact that knocked the old man down.

PF already cancelled his membership (certainly invoking a clause in their contract), so I'd say things aren't looking good for Patrick. Money solves most problems like this, so hopefully he still has a bit left.
