Kraft Orchids Case - Prosecuters Want a Tug Rule?

So once again, absolutely nothing wrong with the warrant, probable cause, or use of cameras.

Yet...they have him on tape dead to the wall on this charge. An entire police force who would love nothing more than to become heroes for busting Robert Kraft. Puffing out their chests on national TV about their prized misdemeanor bust of the century.

And once again, you think there’s ABSOLUTELY NOTHING WRONG with their methods and that this was all legit police tactics.

BUT, for some odd reason.......they decide, what the heck, we won’t prosecute you, Bob. Just admit you’d be guilty. Because we’d win in court, but we just don’t want to go through this process where we’ll be great heroes of justice and validate our entire careers. Nope, nothing for us to be afraid of...no issues with the surveillance or due process here.

And BK rejects their deal at the advice of an all-pro legal team.

If you can’t see that the Police Department is about to eat ****, you’re blind. They offered the deal because they don’t want this going to trial because they know they’re going to be eating ****. Otherwise they’d like nothing more than to celebrate their career defining victory over pure evil (a 70 year old man getting a consensual HJ for money.)

BK will eat **** too if the video is released, but he probably figures it’s out of his hands now and in the judge’s hands. He’ll do everything in his power to appeal and appeal. And the longer it takes, the less anyone will give a crap.

I’ll bet anyone on this forum that BK not only beats the rap but the PD is exposed badly. They offered BK a pretty sweet deal - if they in fact had a strong case here - and he rejected it. They then went right to the video leverage hoping BK would reconsider. They want this to go to court less than BK does. Think about why they wanted to avoid an actual trial and conviction despite getting a massive fish on the hook and what appears to be an open and shut case. They know something is massively f’d up in this investigation.

The plea deal is nothing new. Its called a diversion.

FLA courts are not rolling out something just because Bob Kraft was caught in the snare. This is not the crime of the century, but its still a crime, so something has to be done to deter others from taking the same path as Kraft. Law is a law.

STD test
Counseling
No record

Guilty in court
Big fine
Possible jail time or house arrest
Probation
Criminal record which may be expunged later.

Bottom line - The FLA courts hold all the cards. Krafts lawyers are in the business of telling him to relax and that we got these FLA boys right where we want them.

They offered him basically the sentence he is going to get when he loses. They don’t offer that because their case is weak the offer it because DAs plea bargain 95% of cases.
 
Anyone saying Kraft is already guilty, well, basically you are correct but due process needs to play out. I’m not there yet where I’m ready to call him guilty. Let’s review a few facts here.

1. Any evidence from video was obtained illegally. (A kiddy lawyer could beat this case like a Salvation Army drum)
2. They know they are in violation of the anti terror laws. No not even the police can make a bomb threat
3. They sat there for months allowing this. The optics are bad and the state will lose at trial.

I could say more but this is enough. Any lawyer, especially one named Goldberger, will murder this case even worse than Eminem rapping against ja rule. It’s over

I’m not sure what’s more maddening. Those that want Kraft drawn and quartered for getting a happy ending massage or those who are convinced the world would be rainbows and lollipops if only prostitution was legalized.

I think t's pretty clear that the fans who don't support Kraft now have that view because he didn't stand by Belichick for Crygate or Brady for Defamegate.

You’re living in Fantasyland, and you seem to not realize this deal was offered to all 25 of the Johns. There is not anything even remotely odd about the deal the prosecutor offered them, and it is not in any way whatsoever a sign of them having a weak case. I bet most of the Johns accept the deal because they have different priorities than Kraft (most of the guys want to keep a clean record and pay as little in fines as possible) so you get 20 or so of them out of the way in one swoop instead of tying up the courts.

Welcome to the United States, dude. Stuff like this literally happens ALL THE TIME. You just don't hear about it because uberrich schmucks aren't usually involved.

Also, you're a total hypocrite because you're assuming things out of your azz just as much as you believe all the people you are complaining at are, just in the opposite direction. You have no idea what was put in the warrant application and so even less idea of there was PC or not to issue the warrant or if there was anything legally wrong with the video surveillance.

And I'll again point out that failure to ultimately find the crime being investigated does not mean that there could not have been/was not probable cause to investigate.

No, they did not offer Kraft the same penalty that will be imposed when he loses.

FLA offered Kraft the penalty for a 1st offense.

Kraft is a 2 time offender. He went back to the orchid and there are 2 separate videos.

(b) A misdemeanor of the first degree for a second violation

This means you can receive a sentence as low as a fine or court costs, but it is highly unlikely that this will be the case.

The highest sentence you can receive is one year in the county jail

Most offenders receive the maximum probation jurisdiction of twelve months to complete STD screenings and AIDS awareness training

In some jurisdictions there is also a condition imposed for repeat offenders called “the exclusion zone.” This is a geographical area that the offender is not allowed to enter for the time they are on probation. In closing, the penalty when Kraft drags the court through this dog and pony show and he loses will be exactly as I stated previously.

- The fine wont be court costs and $50 bucks for the courts troubles. $5000 is the maximum for a 3rd offense as a watermark.
- Some sort of jail time or house arrest
- Probation
- A record

I don't support Kraft on this, but there are plenty of folks who don't look at prostitution as much of a crime, even though it's illegal. We've seen that here.

Then there's the irony of the use of cameras. Belichick was called a schmuck by Kraft for filming coaches from the wrong place, but Kraft is now trying to get legal camera evidence thrown out of court to skate by on a technicality.

Of course they need to pass a motion to suppress its official release, but let's be realistic. It will be out there to TMZ within 18 months. There will be some corrupt cop who can't resist the payout from those crappy sites.

Unless Goodell is running the show and has already destroyed the tapes. :p

8 hours of that 5 days a week. 30 minutes for lunch and no breaks. Moreover, Saturday and Sunday are peak days, so guess what, you can forget having weekends off right now. If the Pats are on at 1:00 pm or 4:00 pm too bad.

A judge doesn't have to agree with this board or any million dollar lawyers. A judge can rule any way he/she sees fit. Another judge may grant an appeal but even that judge can rule any way he/she wants.....all the way to the supreme court. Even if lawyers throw all kind of precedent, logic and law it's going come down to the judge's interpretation. The Patriots owner facing a Florida judge, humm, which way do you think that one's decided?
 
the only thing that makes sense to me is that the PD screwed up somehow and they are using a strategy often used on the accused with piss poor lawyers.

I still do not get the whole the PD had to wait from Oct. to March to get enough evidence, how much "evidence" was needed??.. It seems that their focus should have been getting the women out of there to avoid further issues for them.. they did not need a weatherman to know which way the wind blows..

Jupiter Police Mission Statement: "We are dedicated to the safety and security of everyone within our community by providing responsive and professional services with compassion and concern." .. this seems the opposite by allowing these women to be continually victimized for the sake of a "larger order"... It seems that any of these strip mall massage parlors, with the name Asian in their title, are probably offering more than a massage.

It is absolutely not an everyday thing for the PD to offer a deal like this - for an incredibly highly visible person - when the case should be so airtight with the evidence and screams that there's going to be problems with the prosecution because there's going to be problems with admissability of the "airtight" evidence. This same Sheriff who was on television acting like he just won the US Presidency with his ****y victory speech isn't going to take an easy conviction on the billionaire he busted, justifying his six month botched investigation? I guess they want to save their resources and not bother showing up in court to seal the conviction? Sure....there's always gullible people out there who eat this up like sugar coated manure. We have a handful of them in this thread alone. Let's just wait for the case the unravel...because unravel it will, it the most literal sense. The obvious facts of the investigation are strange and unusual. Have you ever heard of a public video being released of the actual act of prostitution? It's odd and totally bizarre because this almost never happens...especially over this excessive time period. Can't wait to hear about the chain of command of stooges watching pornographic videos of presumed innocent people all under the guise of an investigation.

Yeah, it's going to look like an awesome investigation and not a total and utter abuse of power in front of a judge who follows the laws of the actual constitution.
