The new Kessler letter is just tying a bow on Brady's argument. It's sensible. Judge's likely reaction? Just settle this nonsense.

Just smack the NFL down like the dirty dogs they are.

Which is why all the "just settle this silliness now" settlement talk bugs me. It validates the NFL's position in all this and the Wells Report in some way.

Goodell and the Well's Report isn't valid. It started as a misspent attempt at revenge and has since mutated into a massive cover up by top NFL personnel to protect themselves. It's politics and it's dirtiest kind of politics.

You are correct up to a point. But, for example, an agreement to have a rehearing by a neutral arbitrator would be a settlement and a win for our side all at once.

What's absurd here is that the NFL has nothing to gain on an appeal. The best case scenario for them is that they win on appeal, preserving Goodell's right to be a tyrannical dictator under the current CBA. The players would then definitely negotiate that away in the next CBA. And whatever negotiating advantage the league gained from having the courts say "Yes, having that clause with that meaning is allowable" would be more than cancelled by the hostility and bad press the NFL would incur from sticking by its guns.

GOODELL, however, has more at stake. His interests have diverged from the league's by quite a bit.

"Just settle this non-sense" is easier said than done when you're in the right but still willing to negotiate simply for closure and the other side is being this unreasonable.

The NFL is like a "whip lash" personal injury plaintiff who was caught on surveillance tape lying about his injury and they're being offered a few thousand dollars to go away but they're holding out for $1M.
 
I never never never would have predicted that a lawyer's letters would consistently make me smile and feel all warm inside. Never in a million years.

It's useful to summarize the argument at the end, to bring it back to the basics, to focus the Court on what matters and away from the large jumble of facts, arguments and law before it.
 
If Berman rules for Brady, we'll need a Patriots jersey made up for Kessler with number 1 on it. Kraft should then present it at the pennant raising ceremony on opening day.

Kraft should make him an honorary Captain for the Opening Night Game versus Pittsburg. Give him a 12.5 jersey and send him out with TFB et al for the opening coin toss!

I couldn't think of a better FU to Goodell than that
 
Question to you ladies and gentlemen. IF Brady wins (and I'm thinking that's a big possibility) and the NFL appeals, would you consider it a win. Me personally, if Brady wins, I don't care if the NFL appeals, to me that's a win. The Summary of the ****ty Wells Report states they can't definitively prove the Pats and Brady did anything wrong, An NFL lawyer stated in court they have no proof, and if Judge Berman agrees with Brady, I consider this over, and proof the NFL tried to railroad the Pats and Brady. An appeal after that proves nothing to me, even if the NFL wins that appeal.

i would think winning an appeal of a federal judge is more rare than having an arbitrators ruling overturned.

Plus, the NFL lawyers really have no game or grounds. But, the longer it goes on the worse they look, so we have that going for us too.
