It was a bad call, but for an offensive player, you cann't initiate contact after the 1yd and not the 5yds. Defenders can climb on your back before the 5 yds and you can't touch them. That is how the rules are written. Meaning WRs and TEs are screwed if they are not crafty and do things outside the vision of the refs. Problem for Gronk is that all the officials are looking at him from all angles.
