Kraft Orchids Case - Prosecuters Want a Tug Rule?

They want him to admit to what? That he got a bj? if there is video evidence, why would it matter if he admits to guilt now or goes to trial ?

He won't dispute the hummer. Depending on how it all went down he could make the case that she just wanted to blow him because he's a famous rich person.

I'm not a lawyer or in law enforcement but for your average Joe this isn't something you would want to use your meager resources to fight. But unless there's a clear sex for money situation here if you're someone with Kraft's resources you might try to fight it by saying that you paid for the massage, not the blow job, and the tip you gave after the blowjob was just because you always tip people.

I doubt he cares very much about what will happen to him if found guilty because it will be a slap on the wrist. He may just want to fight a losing case to establish his story in the public's eye. "I paid for a massage, she liked me, she had oral sex with me."

Now if she said "I will blow you for $100" and he gave her $100 I don't think he can make this case.
 
Someone let Kraft know that I pulled up his statement on deflategate.

He can just cross out "Roger Goodell" and put in a "Law Enforcement".... I'll save him some money so he doesn't have to pay his lawyers. He can send me a check.

"I'm going to accept, reluctantly, what (Roger Goodell) has given to us and not continue this dialogue and rhetoric, and we won't appeal," Kraft said during the media conference. "This is the best thing for the New England Patriots, our fans and the NFL."
 
So you're either going to assume this is white/rich privilege.

Or you're going to assume this is because it wasn't actually a place filled with trafficked sex slaves.

I guess it all depends on how much faith you put in Florida police or what sort of axe you had to grind about this case.
The same deal was offered to the others and this kind of offer is done all the time for all kinds of cases. If your post wasn't rhetorical, I'd be curious about why you think this deal is being offered

PS - after that initial news conference the police/prosecutor's case has popped like a balloon.
After getting the gist of the offer (a course on prostitution, STD testing [LOL] and 100 hours of community service - this is the same thing as pleading guilty, not dismissing the charges), I revise my answer.

Bob's attorneys should call up the prosecutor and say as follows, "Obviously you have no case, or you're worried that videotape is getting suppressed. We'll agree that if you place the charges on file without a finding for one year (or two years if you think Bob isn't in danger of running afoul of the law) Bob will have no further charges and provided that happens, you will dismiss the charges after that one (or two) year period. If Bob gets tagged again for this type of offense during the operative period, then you can bring the charges forward and Bob will have to plead guilty then.

It's called placing a charge on file and I would be looking to do it (and yelling at my client that he'd better stay the heck away from any massage parlors) if I am smelling weakness in the prosecutor's case.

I agree. I think they don't want to tie up the courts with this and want to focus their resources on the business itself.
 
Amazing Karma... Now he'll know what TB12 felt like when he was forced to accept punishment (tantamount to admitting guilt) for something he felt he didnt do in the deflategate debacle. See how Krafty Bob likes it...

Its a bit different tho, because Brady was innocent and Kraft is guilty

Really good lawyers could destroy that video evidence if there was no audio with it. Him getting a Handy J doesn't prove he asked her for one or offered to pay money. Exchanging money with her on video also isn't damning evidence, because he could argue he was just tipping her for the massage which is what anyone does

There are ways you could spin it with a crack team of lawyers.. they would need audio of him offering her cash in exchange for sexual services to really get the solicitation charges to stick

There is also a chance they could get the video evidence thrown out completely... in which case the prosecutors have no case whatsoever

I think the deal is being offered for much the same reason that a lot of the girls ended up arrested. Because there was no sex trafficking.

If there was sex trafficking/sex slavery going on the idea that they would be letting Kraft off this lightly would be infuriating beyond belief to me. The Florida PD made a big deal about sex trafficking, horrible conditions, etc and now the prosecution is offering to drop charges? Either Kraft is getting away with something truly heinous or the sex trafficking was ********.

They wouldn't necessarily agree to do this, but they might offer you something more palatable than pleading "no lo contendere" (fancy Latin for "I don't contest the charges" which is akin to a guilty plea), which is really all they are offering.

Pretty sure they are offering this to everyone they charged not just kraft. It’s standard procedure and essentially a plea bargain.

The guy paying the hooker isn’t the guy that is guilty of sex trafficking.
Arguably they are just an annoying side effect of a bigger investigation.
What happens to kraft is irrelevant to the sex trafficking case.

I don’t think the “offer” indicates they have a weak case, I think it indicates they don’t want to clog the courts and offer plea bargains all the time.
ACOD doesn’t seem to be what the state is interested in doing here.

That is an argument that fails far, far more often than not. Judges aren't morons. They aren't going to buy the notion "hey, I was just tipping her for such a great massage, the hand job was free because she liked me so darn much!"

No, they really wouldn't need any audio if they can establish money changed hands and a sex act was performed.

The tricky thing here is that Bob Kraft isn't even remotely concerned with the criminal penalty. He's not going to jail and something tells me he can afford the fine. But he is very much concerned with NFL penalties and reputation damage. He's probably also pretty concerned that the video never gets made public.

No, there’s really not. It’s basically the same “possibility” that someone would get for having a joint in their pocket. Kraft is a first time offender for a crime that won’t even be on his record once he completes his community service. There’s a decent chance that he doesn’t even receive probation, let alone actual jail time. That would be absurd.

The sentencing guidelines and score that the judge would use wouldn’t even have jail time as a possibility.

The difference is in how it impacts your criminal record moving forward.

It is dropping charges and it is likely a good deal for the regular-joes involved. I doubt many of them would want to have to talk about having been convicted of solicitation the next time they apply for a job or loan or something along those lines. I bet the regular-joes involved take the deal.

Bob Kraft is a whole 'nother matter entirely. His concern is not with criminal penalties or filling out job applications.

Well I'm certainly no ace lawyer.. i just assume if they can get OJ off on murder, Kraft can get off for a simple handy J (pun intended)
