Michael McCann seems to think this could sink their whole case. According to him, the fact that the NFL assured the Patriots, Brady, and the public that it was independent and it wasn't could be a reason they lose. My guess is that they interviewed Brady under false pretenses. He thought he was being interviewed by an independent investigator, but in reality Wells and his staff were representatives of the NFL.
Yes but how does or does not the CBA cover that. That is the key there right ? They said they were independent but they werent so what ? How the judge put that in case of the cba violation. Or does he not need to?

This is embarassing for NFL. They know they are lying and everyone knows they are lying but they are shamless
 
Wait a second. If Wells is not independent then he was legal counsel for NFL during investigation.
How could he then investigate the Patriots concerns of intentional misinformation and leaks?
Answer: He could not. You can't investigate your own client.
Yet they TOLD the Patriots Wells would?

What?

The NFL* was positively forthcoming about correcting the incorrect PSI readings when compared to how long it took them to admit that Wells was not independent.

So if I'm understanding, since Judge Doty already ruled on the subject of required notice re: NFL and NFLPA, that issue can't be contested here? Despite being in a different circuit, because the parties are the same, the issue can't be taken up again?

Again, I am only guessing because I am not a lawyer or know the CBA, but Wells didn't need to be independent to investigate under CBA. But the federal "laws of shop" rules, the deception of investigating under the guise of being independent when really not could come back to bite them. Again, I am guessing because I don't know this stuff.

In sum, NFLPA memo criticizes notice, precedent, bias, lack of policies, etc. NFL memo responds by saying: "It's in the CBA." We'll see.

I mean we are only getting people's spin online, but it seems that the NFL approaching this with the same arrogance of "we are the NFL and we can do whatever we want and don't have to explain ourselves" that they do with everything. Meanwhile the NFLPA laid out a painstaking case to attack this from numerous angles.

I am thinking that the NFL's record vs. Jeffrey Kessler might be even worse in a few weeks.

Can't the NFLPA just ask Judge Berman to follow the precedent set in Missouri in that Goodell cannot be an arbiter?
 
"It's in the CBA" is a convenient excuse for Goodell to abuse his power.

And it's why the State of Missouri ruled Goodell can't be the arbiter for teams in that state anymore.

Why doesn't an owner(s) step in? Because in this day an age ANY publicity is good publicity. Joe and Jane Shmoe will now tune in to watch what happens with brady and the pats which =more $$$$$$$
