NFL News Semi OT: Flores suing NFL and NYG. Texts from Bill involved in the suit.

Flores is going to have a difficult time proving discrimination unless there is a smoking gun out there. Right now, it's just a circumstantial case.
The three teams involved have a few excuses:

Giants - We were looking for an offensive minded coach because of our young QB. So if we were leaning towards hiring Daboll before the Flores interview, it's because Flores was a defensive minded coach. There was no racial animus on our part.

Broncos - Flores was a great candidate, but his record in Miami was less than appealing. Plus coming to an interview hungover shows a lack of professionalism, but not discrimination. We also hired Vance Joseph, who is black, to be our HC in the past.

Miami - We hired Flores and he just didn't produce. We gave him a shot. Also, our GM is black, so we don't discriminate as an organization.
Denver interview was in early 2019. This was before he landed with Miami - right after they fired Joseph and during interviews where they ultimately hired Fangio
 
Head coach, yes.
That doesn't seem possible. It seemed like that just a few years ago there was 5 or 6. Maybe, I just remember it wrong.

You aren’t missing anything. Anyone white is presumptively racist and every action involving a minority is solely driven by race. Ask your kids, they are being taught this in school.

Ok still, there isn't much initial evidence out there that Flores was denied HC opportunities by those NFL teams because of race. There could be something that is found during discovery but so far there is not much there.

I would also find it difficult to see how a court would certify this is as a class action. For class actions to work, there needs to be a large number of plaintiffs treated the same way by each of the defendants. Here, there is only one plaintiff (Flores) and others plaintiffs have not joined the suit. In any event, let's say 10 other black coaches join in the suit, each one of them having a different grievance against a different set of NFL clubs. Every case of alleged racial discrimination by them would be unique and the court would not likely certify the class, forcing the plaintiffs to file individual lawsuits or do so as joint plaintiffs. This is different than say a Massachusetts company contaminating drinking water in Woburn, MA, where every town resident has the same grievance against the company. My 2 cents.

An interview is a sham if the hiring team has already made a decision prior to seeing additional candidates.
A decision includes accepting and agreeing to terms.
Clearly that hadn’t happened by the time bb texted.

It’s interesting because the argument seems to be that the Rooney rule creates racist hiring if you don’t hire that candidate. If Flores was only interviewed due to the Rooney Rule then he wouldn’t have made the cut for interviews any way. Can't prove this, can't prove that. There, that settles it. Whatever. 1 back head coach in the NFL is an embarrassment.

So your argument is that if they made up their mind to offer the job to Daboll but he had not accepted it, then continuing to interview is a sham? What if he took the saints job, or the Houston job?

It's imperfect for sure. But I think Flores is trying to make a case of systemic racism beyond the Rooney Rule.

No, a contract involves an offer and an acceptance of the terms. A decision is when you make up your mind to do something but have not yet consummated it.

Once you make up your mind, the rest is a formality.
Once you have made the offer and it is accepted the rest is a formality. I hardly think the interview with the guy you hire is a formality, and that had not happened at the BB spread gossip.
