Well now we know where the speculation on the severity of the punishment is coming from:

Section 2 Extraordinarily Unfair Acts
Article 1 The Commissioner has the sole authority to investigate and take appropriate
disciplinary and/or corrective measures if any club action, non-participant interference,
or calamity occurs in an NFL game which he deems so extraordinarily unfair or outside
the accepted tactics encountered in professional football that such action has a major
effect on the result of the game.
Article 2 The authority and measures provided for in this entire Section 2 do not
constitute a protest machinery for NFL clubs to avail themselves of in the event a
dispute arises over the result of a game. The investigation called for in this Section 2 will
be conducted solely on the Commissioner’s initiative to review an act or occurrence that
he deems so extraordinary or unfair that the result of the game in question would be
inequitable to one of the participating teams. The Commissioner will not apply his
authority in cases of complaints by clubs concerning judgmental errors or routine errors
of omission by game officials. Games involving such complaints will continue to stand
as completed.
Article 3 The Commissioner’s powers under this Section 2 include the imposition of
monetary fines and draft-choice forfeitures, suspension of persons involved in unfair
acts, and, if appropriate, the reversal of a game’s result or the rescheduling of a game,
either from the beginning or from the point at which the extraordinary act occurred. In
the event of rescheduling a game, the Commissioner will be guided by the procedures
specified in Rule 17, Section 1, Articles 5 through 11, above. In all cases, the Commissioner
will conduct a full investigation, including the opportunity for hearings, use of
game videotape, and any other procedure he deems appropriate.

If this IS the passage under which some penalty will be levied,
it will be interesting to review the reasoning
by which these extraordinary criteria (in red) have been satisfied.

IIRC, the tape was confiscated before halftime (sometime in the second quarter, please correct me if I'm wrong). In this sense, there is no feasible way the Patriots could have accessed the tape, deciphered any meaningful footage, and used said footage to "cheat."

However, the Patriots did violate policy. So I believe that the big question the commisionior needs to answer is how the penalty will be exacted.

You'll notice that none of these documents contain anything prohibiting the Patriot's actions.

The Patriots violated the Game Operations Manual, a rather large document which governs the minutia of what happens on game day. (i.e. when a tarp must be placed over the field.) I am unaware of any violation of this document which has ever resulted in anything more significant than a fine, with warning letters being the standard consequence.

Clearly that would be insufficient in this case. If the only penalty is a fine, every team will ignore this rule. But whatever Goodell does, it will be a significant break from precedent.

In my opinion, the league needs to create a separate document governing the use of technology on game day, and create a new enforcement division with the authority to inspect each team's gear on gameday. Without this, there is no punishment which will prevent teams from spying, because they can be confident that they won't be caught unless they are REALLY blatant (like the Pats ).

Does anybody know and can point to a link to where it is said when the photographer was caught. As we all know, there is a certian picture f;oating around the sports world that shows a photographer taking pictures of the Jets staff. The time on the screen is 5.17 left in the first. Did they catch him before or after.

Second, did they catch him before half time? If so, then the tapes/ pictures couldn't have helped in the second half.

I know we can't defend the Patriots on this,:bricks: but can we show that the world condemning the Patriots on the wrong evidence?

If not, can we bring back Pat Patriot, put an eye patch on him and call our selfs the patriot raiders. (I'm not proud of what happened, but I'm not too hung up not to make a joke or two either)
