A few of the Dallas mediots have inquired with the League Office and they have confirmed it's a first rounder. This one asserts it because Austin was originally undrafted and tendered at the highest level, that the original round tender is allowed to be a first for Spears.

I don't think it matters much, nobody's offering up a first or second for Spears.

Interesting, so they went for a completely literal interpretation to say that the rule doesn't apply to guys that were UDFA's, thereby completely ignoring the spirit of the rule. Chalk up another win for the NFLPA.

NP, though I think the NFLPA would prefer he be ruled a second round comp RFA on an orignal round tender than a first round comp RFA on original round tender.

Absolutely (I was being facetious), either that or that he receive the higher $ amount for the 1st rd tender, as the rule intended. Yet it doesn't seem to bother the NFLPA all that much when their constituents get screwed. If I were Spears, I'd be pretty pissed.
