It's hilarious that people are pushing the narrative that if Brady had admitted to wrong doing it would have been no big deal. Isn't that what happened with spygate?

It's only a fantasy for hasbeens, who were eager to see Brady admit to being a cheater. It would invalidate their losses to Brady.

A highlight to me in the Yee interview on CNN was Lee's statement that the reason why Tom didn't make available his text message records is that they didn't want to set a precedent that would open up the floodgates so that the league could ask for (though they can't subpena) other NFL players text messages in the future. Yee intimates that the NFLPA would be up in arms over such a precedent.

In the event that the league hands down a penalty to Brady and, presuming their is nothing incriminating in those text messages, I think that I think Yee should intimate (in such public fashion) that they might make available said text's ...... and see just how quickly the NFLPA and Brady's fellow players react.

The NFLPA has been on top of this since day one. They were the ones who advised all players not to make their phones or personal communications available to the investigators. If the league wants that power, it's going to have to negotiate for it in the next CBA, and they'll find that it won't come without major concessions re: Goodell's role as judge, jury, and executioner in these matters.

Don't know that Yee should have said that. That can be trivially spun against Tom: "Yes, the other QBs aren't so cozy with part-time equipment guys because they aren't having the guys illegally deflate balls for them."

Hopefully and maybe behind closed doors the NFLPA is plotting their next move, but wouldn't they be against the precedence of passing judgement on Brady based on circumstantial and presumed evidence. No court of law would even try this case based on the preponderance of evidence that Wells has gathered.

That's what gets me here. The league wants to act like this is a civil case and because they say they have preponderance of evidence they do. But if this was an actual civil court what they have simply wouldn't meet the preponderance of evidence standard. ****, they haven't even given remotely compelling evidence that tampering occurred in the first place, let alone whether or not Brady knew about it.

The term 'preponderance of evidence' loses all meaning when the person making the judgment isn't actually making it based on the ****ing evidence.

I think you are taking it out of context. In fact, you've not actually given the context in which it was mentioned. Yee mentioned it last night because it was a question asked of him and he mentioned the rule and what the rule states.

I see on the news ticker above that Yee used the phrase "malice intended" toward Tom Brady. Dude. Them's fightin' words. Yee is a highly respected attorney and those are not words used lightly.

eta: OK, that came from an NPR transcript where Yee says he thinks there was "some malice intended" toward Tom Brady and the organization. Then he says "I don't know if it was intentional." That's….really getting down into parsing words.

Still, I doubt that's unintentional. Actual malice is the biggest hurdle for establishing libel against a public figure. Throwing a term like malice out there is an easy and clear way to indicate that Brady is prepared to pursue a libel lawsuit against the league over its conduct.

I dont think its a big deal .Brady having a good relationship with the equipment guys. Whats wrong with it ?

I didn't say I thought there was anything bad about Brady being close to the equipment guys. I don't think there is.

I said it would be easy to spin that statement in an anti-Brady way. Which it is. Mark my words -- before the day is out you'll see some mediot putting precisely that spin on it.

Yee is talking about the fact that the NFL purposely left out of the report the content of the text messages that went back and forth between Brady and Jastremski despite the fact that the league had full access to those messages through Jastremski's phone.

Yee also is saying that other QBs don't have the same relationship with the part-time equipment guys as Tom does. Which is probably true since we know that Tom is a good guy and goes out of his way to treat people fairly. Unlike other QBs around the league.

Tom has also been in Foxboro for 15 years.
