If the Giants made it known to staff that Daboll was going to be hired prior to the in person interviews with Flores and Frazier, then the Giants are guilty of breaking the Rooney Rule.
My understanding is that the Rooney Rule only applies to interviewing quotas and not HIRING quotas. If they interviewed two outside minority candidates, then wouldn't one argue they satisfied the Rooney Rule requirement? I think the question becomes is it ILLEGAL (or against the Rooney Rule) to extend an offer (verbal or written) to someone then continue to interview other candidates? My understanding is that you can extend an offer to someone and still continue to interview other candidates until the offer is accepted at which point the job req is considered closed. Many times, a favorite candidate may reject an offer. I've seen offers extended and interviews continue all the time in case an offer is rejected, so an open position can be filled timely. It happens in nursing in small nursing facilities all the time because of the importance with time to hire and staffing shortage issues. For example, you interview 4 candidates, extend a verbal offer to candidate 3, candidate 3 states they would like a week to think about the offer, you continue to interview other candidates incase candidate 3 rejects the offer, then candidate 3 accepts the offer and you close out the job req. Nothing illegal about it, because a job is not officially closed until an offer is accepted/contract signed. Even if the other candidates had little chance because there was a preferred candidate, I don't see how that's illegal either. It may be bad HR practice at best (ranking candidates based off their resume alone or word of mouth vs also considering interview performance and reference checks).

You clearly don't understand lawyer hyperbole.
The lawsuit isn't as week as you claim. You'd know that if you had actually read it beyond just the hyperbole..

I don't think you realize how lawsuits work, either. They don't put all their evidence into the lawsuit. Just what they claim they are able to prove.

To claim that what BB heard was a "rumor" is just laughable. You make BB sound like a lemming who just wildly sends text messages whenever.
I no doubt believe the NFL is quaking with regards to what ‘discovery’ would likely reveal…

Example:
From Giants
To Brian Daboll

Brian
Glad to have you aboard. We’ll make the announcement soon after we finish up with the last few mandatory interviews.

You're missing the point. The lawsuit isn't about the Rooney Rule. It's about the NFLs abysmal record of minority hiring practices. Giants is just one exhibit of how their system is a sham. They won't have any problems showing their hiring methods show a pattern of discriminatory practices.

This issue has been around for a long time. I venture to say that the Rooney Rule was put in place to forgo exactly these types of lawsuits. BFlo just had the balls to step up and shine a bright light on the whole corrupt system regardless of the personal consequences to his career. Good for him. F*ck Goodell.

I wonder if Bill spiked his phone in similar fashion to the Surface Pro after that ****up

I read the entire court filing and think it is a weak case from a legal standpoint, but also clearly the type of case designed to win in the court of public opinion and pressure a settlement that way.

Most of the filing discusses things which are completely irrelevant but designed to make others look bad. For example, maybe Ross offered the $100k per game to lose or maybe he didn’t, but how does such an offer constitute even a shred of racism? Oh sure it shows what a sleazy organization the Dolphins, and by extension, the NFL are. Some people think it could get Ross (and others) into a lot of trouble, and it is one of the things we are all talking about. But where is the racism in that offer?

The one problem with VOLIN'S interpretation is this text, which he clearly ignored:

Why would the BILLS tell Belichick that Flores is the guy for the Giants?

It's much more likely that Belichick realized his mistake after Flores asked him WHICH Brian he was referring to..
Why would he say I hope it works out for you if you want it, if it was a done deal? He thinks he is speaking to Daboll, and clearly understands he hasn’t accepted any job, hence the job is still open.

That is one impressive interview. The full video is amazing. Please watch it. Blacks can't swim because they are not buoyant.
All these years of living and I never realized that black folk weren't buoyant. Patsfans is a wealth of information!

It shows that BFlo was just hired to tank the season so they could fire him after they got what they wanted. Unfortunately, Flores kept on winning with a less than talented team (2 b2b winning seasons). They fired him anyway, which was a shock to almost everyone in the league. They then proceeded to bismirch his reputation, which was extremely odd since most experts considered him to be a good HC.

This is all part of a narrative of institutional racism in the NFL hiring practices for minorities.

The whole thing screams of sour grapes because he got fired and not hired. If he is such a man of integrity why didn't he come forward 2 years ago when Ross asked him to tank?

Wiggy says the only solution is to have more black owners. Good luck with that. Even MJ does not have enough capital to buy an NFL team. Very few people on earth do.

Interesting argument made in the lawsuit. Arguing that coaching hires are racist, they listed the % of coaches/execs in each role that are black. The US population is 12.4% black

Note this is % of jobs which includes open positions ie if Leftwich, Flores, Graham etc are hired it would change these, maybe dramatically.

HC 3%
OC 12%
DC. 34%
STC 25%
QBCoach 9%
GM. 19%

How do you have more black owners? Are we suggesting that teams have been for sale and competing go offers from black buyers were rejected because the seller refused to take the best deal because it was from a black buyer?

We need more white players in the league, IMO. It’s unacceptable that the league has so much black representation and that whites are underrepresented.

Good for you Flores. If you feel you've been wronged and discriminated against by all means do everything you can do.

It is laughable. Those franchises are handed down to kids and grandkids. No one is selling off a multi-billion dollar franchise.

I think it was about 4 years ago or so and I had read that Irsay was offered $5billion for the Colts. They were valued at the time at $2.5 billion. He said no.

What the suit is asking for

23. Among the other relief sought, Mr. Flores seeks the following injunctive relief:
i. Increase the influence of Black individuals in hiring and termination decisions for General Manager, Head Coach and Offensive and Defensive Coordinator positions;
a. Ensure diversity of ownership by creating and funding a committee dedicated to sourcing Black investors to take majority ownership stakes in NFL Teams;
b. Ensure diversity of decision-making by permitting select Black players and coaches to participate in the interviewing process for General Manager, Head Coach and Offensive and Defensive Coordinator positions;
ii. Increase the objectivity of hiring and termination decisions for General Manager, Head Coach and Offensive and Defensive Coordinator positions;
a. Require NFL Teams to reduce to writing the rationale for hiring and termination decisions, including a full explanation of the basis for any subjective influences (e.g., trust, personality, interview performance, etc.);
b. Require NFL Teams to consider side-by-side comparisons of objective criteria, such as past performance, experience and objective qualifications;
iii. Increase the number of Black Offensive and Defensive Coordinators;
a. Create and fund a training program for lower-level Black coaches who demonstrate an aptitude for coaching and an interest in advancing to a Coordinator position;
iv. Incentivize the hiring and retention of Black General Managers, Head Coaches and Offensive and Defensive Coordinators through monetary, draft and/or other compensation such as additional salary cap space; and
v. Complete transparency with respect to pay for all General Managers, Head Coaches and Offensive and Defensive Coordinators.
