Another win for RK. I am happy with this outcome and hope that the case is dismissed. Yes RK's public image has taken a hit. I do expect the tape to be sold to the highest bidder by someone at that police department. Sad but those are the times we live in.

Absolutely. Never talk to a police officer, or allow them on your property (if it's gated/fenced) or in your home without a warrant, unless you're the one lodging the complaint/request. It's not personal.
 
What in the world are you even talking about here? The judge didn't say any of those things. He didn't say a single word about the traffic stop, he didn't say that the warrant was based on false pretenses and he didn't say that the police lied in any way.

What he said was the police didn't do enough to minimize the recording of innocent persons using that establishment, therefore all the video evidence is inadmissible. In other words, Kraft is getting off on a technicality.
Just to follow up on my previous post to make a few points clear. The ruling states:

1) I was mistaken to say he didn't "say a single word" about the traffic stop. I blew past the last paragraph where he does mention it. My bad.

2) The Judge does agree there was probable cause to place video surveillance in the establishment

3) He also said the defense "failed to prove … video surveillance is unreasonable under the circumstances."

4) The reason why the video evidence is thrown out is because of the aforementioned failure to employ the proper minimization techniques. He called it "unacceptable" that innocent people had their lawful activity monitored.

5) IMHO, Roger Goodell will not give a damn about any of the above

A lot of wasted time, effort and taxpayers money for a solicitation charge and a 500 dollar fine. Time for them to drop the charges and go back to fighten alligators.

I wonder how this affects the case against the sex workers. I would assume that throwing out the videos will make the prosecutors case an uphill battle against the workers. What a total waste of time an resources by the SA. Florida is rampant with an opioid crisis and they're wasting their time on consensual sex charges.

Unfortunately I agree with others that the video will probably be leaked by the not too happy JPD.

You know in close to 2 decades on this site, I have never ignored a poster. When I figure out how to do it this ******* will be the first. And he better hope his path never crosses mine in the real world, because I hear that it's REALLY embarrassing to get your ass whipped by a 72 year old
 
Well first, you’ll note that the video is NOT being released, at least for now, and I would predict not until the judge rules on the constitutional issue. Without doing a bunch of research on Florida law, however, I can’t say much more. Florida obviously has some pretty liberal “right to know” or “sunshine laws.” Why don’t you google those and then google cases that cite them and you can get a pretty good idea of what’s discoverable in FL by nosy folks. I have a hard time believing that tape will ever see the light of day if it’s ruled inadmissible but I am not a FL attorney nor a criminal attorney. By the same token Kraft has an uphill battle to suppress a tape that was obtained through a warrant, although there are certainly colorable arguments either that the cops exaggerated the circumstances to obtain the warrant, or “searched” in excess of what was allowed. Now the prosecutors appear to have done something underhanded- agreed in Kraft’s case not to release the tape until a ruling by the judge, then announced only days later that they “have to” release it in a related case. Not a good look for them; and now they have a complication that I wondered about earlier in this thread - what about folks who really were there just for a massage who are now on tape? That is a horrible invasion of their privacy. I’d be suing for damages too. And what do you do with those tapes? There is absolutely no justification for releasing those under any circumstances and if the cops were smart (which they are proving they are NOT) they would have immediately erased any tapes of folks who did not engage in criminal activity. That doesn’t get them off the hook for watching ordinary folks undress however.

Legally it’s actually a very interesting case.

What was I wrong about?

I fully accept the arguments that I did not make, the beliefs I do not have, the conclusions I did not draw that were attributed to me were wrong.
If I said them, I would be wrong. I didn’t say them.

To answer your question, you had a lynch mob against law enforcement and I argued there were no facts available to prove it.
That turned into the lynch mob arguing against a position they attributed to me that I never took. There are no “debating skills” that prevent that.

I guess I could just join the mob mentality and not worry about facts, but that’s not me.

The judge's ruling seemed to be particularly peeved that a female client who was there legally had here visit ( seemingly in a state of undress) monitored by a detective....
 
If the search was ruled illegal then it was illegal. (Assuming it stands)
Looks like my police buddies were talking facts Andy. Always trust what they say
 
What did we learn here? A billionaire can buy his way out of a soliciting sex charge. Fantastic. I feel nothing but disappointment about this stuff. People can celebrate him getting of a technicality, but I think it is just sad.
