Kraft Orchids Case - Prosecuters Want a Tug Rule?

Considering it’s such a minor offense, it’s nothing to get all riled up about even if he is guilty.

But if the police used deceptive tactics to get the video warrant, that’s far worse than paying for a handy. If the did, I’m pulling for the lawyers to make them look like the idiots they likely are

The only folks getting all riled up about it are those who are claiming that the police violated someone's right's, which there's no proof of in Kraft's case. If I were basing my opinion on what I've seen so far, he looks to be guilty.

As for solicitation being a minor offense, it's still a crime. When Rudy Guliani cleaned up NY (relatively) he started with the minor criminals and the more serious criminals fell into place.

Since your response ignores the additional fact I mentioned that Fox News is only one of many media outlets looking for Kraft to be punished I'm going to have to wonder if you have an agenda with them.
 
He may be punished hard to send a message to the players ... I am not sure.

Unfortunately, Goody and the 32 can do whatever they want to Kraft.
 
The fact that Kraft made the evening news will be enough for the NFL
to give him a stiff punishment.

I think it's all coming to a head soon and Kraft may get off.

All the workers there get to input to the editors their ideas for funny headlines.
Learning that made a lot of sense on those priceless headlines.

Judge asked Media Attny: if I were to rule to suppress video what would your argument be on disposition of video. She said, even if he rules to suppress video, the media would still have access to it by Chapter 119 (or whatever it is).

Kraft's attorney sounds like Vincent Gambini, lol.

EDIT: This feels like it is going to drag on unless judge suppresses evidence and SA drops charges. Otherwise, this may be hearing after hearing with potential appeals, etc.

Hmmmm.....so they need that video released but would still have access to it anyway? Then why are they in court? That’s not a good argument at all btw.

The Judge didn't make any rulings on the Defense motion to suppress or on their motion to protect the evidence. He also didn't make any ruling on the media's desire to be a party to the hearings or their access to the evidence.

He just threw a hypothetical at the female media attorney, that if he were to rule the video to be inadmissible, what would she then claim. She said that even if the judge ruled the video to be inadmissible, that the media or anyone really would still be entitled to the evidence because of Florida open access laws, citing Chapter 119 of Florida Statutes.

If she is right, then those are some pretty crazy open access laws. This is something Quantum brought up as a possibility which I thought was crazy.

That's how my non lawyer brain sees it. I thought part of
his strategy was to use every delay tactic there is to keep that video
sealed. As long as the case is open I don't think the media can get it.

Well at the hearing his lawyers said they wanted a speedy trial which would be by the end of May so they're not delaying that much.

My non-lawyer brain can't comprehend how evidence that could be tainted or illegally obtained and not good enough for a jury to view can just be turned over to the media for them to then publish online so person is tried in the court of public opinion with illicit evidence. That's just crazy. We'll have to see how the judge rules on this.

So they have removed the "under seal" from the entire state of Florida? What if a minor appears in one of their videos? What if there are national security reasons? She may be correct in the end that they'll have access to it, but that seems rather naive to assume that anything in evidence will automatically be released regardless of powerful sunshine laws. It sounds like the judge was looking for an actual legal precedent for appeal rather than a "one way or another, I'll get my hands on it, so your ruling is irrelevant." Maybe I'm missing something, and I'm sure she wasn't using a tone like that, but it seems like an idiotic answer to me.

All I have is my opinion, like everyone else. We’ll find out if the police abused law the in the months to come. That’s the way it appears to me.

In my opinion, there is far too much “OMG!”:eek: going on over misdemeanor offenses. Let’s remember, what Kraft is accused of is the same offense as the other 30 guys got busted for.

The difference is he’s very wealthy. And I’m not a fan of people that have some inate disdain for wealthy people. I view them the same as I view everyone else. The Kraft family is incredibly giving and I’m ok (like absolutely, totally ok) with what he likely did.

I agree ... Reminds me of bankruptcy proceedings where anyone can throw crap at a judge and they can review it regardless of how credible it may be. But from what I have read burying that video is not going well and I doubt Kraft's lawyers suck.
 
So there is talk that they now have 1 or 2 witnesses to testify regarding Kraft to add to the video. Supposedly they have not yet been charged but it is being dangled (no pun) if they do not testify.

Now we know why the other girl wasn't charged, they kept her in their back pocket if needed. Testify against our big fish and you walk.
