To sum up the NFL/PA arguments in 2 tweets: 1) NFLPA-- the commish didn't have the right to do what he did under the CBA or labor law.

Gabe Feldman ?@SportsLawGuy 2h2 hours ago
2) NFL: we considered all of the NFLPA's arguments & rejected them under the CBA, & court does not have power to second guess NFL's decision

Copy of Hardy suspension decision submitted to court by PA:"10 gms is simply too much,in my view,of an increase over prior cases w/o notice"

"deferential standard of review for arbitration decisions. "

only way brady loses..and it's likely. god, i hope the players association. so ****ing weak/no spine

Is the Berman meeting next week with Brady and Goodell on the record?

I don't think so. I really doubt settlement talks would ever be made public.

I just don't get the nfl argument. They claim that Brady could be suspended for his actions due to the fact they were detrimental to the integrity of the game and thus goodell has the authority under the cba to issue the suspension. However, Brady was clearly told that he was not subject to discipline for not handing over his phone during the Wells investigation. I just don't see the logic. Can someone play devil's advocate and paint me a scenario where their stance is legitimate? I don't see it

Everyone thinks Judge Berman doesn't want to hear this case because he is pushing so hard for a settlement. But I am guessing he will hear it, but would rather not embarrass the losing side with his decision if they could work it out.

goodell has all the power. he can basically do whatever he wants.
demaurice smith has some nerve to want to sit next to brady during this. if tom loses, he should blame the **** players association.

berman doesn't want to hear the case because he doesn't want to get involved with arbitration situations..which is why im not as confident as some of our friends on this site.

Why do you assume nfl thinks its a legitimate argument ? Now its about ego and arrogance. They know its ********.They have nothing to lose -goodell still earns his money and owners wont care but brady has eveyrthing to if suspense is upheld.

We don't know. That is what people are speculating. I think he may just bea no nonsense judge wants cooler heads to prevail and try to settle this at all costs before going to court.

Maybe NFL has paid off people in nyc. Thats why I dont trust them. They are like the mafia right now.

You have that slightly, but significantly, wrong. Brady was not told that he would be subject to discipline. So the inference was that he would not be subject to discipline, but it was not explicitly stated.

NFL: "Commissioner did not discipline Brady for merely being “generally aware” of violation of playing rules." Says for scheme/obstruction.

See Andrew Brandt quote above. Agree with you about the obstruction part, but the "scheme" part is saying that in their view he schemed to violate playing rules, and thus the reason for the suspension.

This judge isn't doing Goodell or the NFL any favors. His decision to not seal all the documents clearly was was the NFLPA wanted the NFL didn't. I am assuming Judge Berman knew this when he made that decision.

I haven't seen this judge seem particularly biased towardthe NFL thus far. If anything, he seems to be siding with Brady.

Not only on the record, but it will be public (no cameras allowed, though). So if you hightail it to NYC and get in line early enough, you can be in the courtroom for it.

Goodell literally lied in his briefing on what happened during the appeal. He knowingly and blatantly lied about information he was told during testimony and used that distortion to base his judgement on. How on earth is that not enough to throw the entire thing out by itself? Far stronger cases have been wrecked by such procedural screwups.

Does the judge not see this? He must right?

how on earth is not open and closed defamation?

We have proof that he intentionally lied multiple times at a detriment to tom brady and his reputation.

I don't think you are right. Mediation sessions are not for the public. Only if they go to trial.

Thanks, but I'd rather read about it here

Like most people here i am assuming, i am a legal idiot.. Can someone with some know how explain how many of these points have to be right for brady to win? Is it one, two, five, all of them. Please help we all thank you on advance.

True, but I'm pretty sure this thing on the 12th isn't a mediation session.
