They can be on different pages without being in conflict.

All Brady has to do is convince Goodell that he didn't tell Jastremski and McNally to do anything against the rules and that he had no subsequent awareness of any such actions when he made public statements to that effect. Remember, he's there because the Wells report says that it is "more probable than not" that he had knowledge of their activities. He doesn't really have to get into the debate about the science that suggests the balls were "deflated" unless this goes to Federal Court. So, it's Kessler's job to allow TB to make those points while also indicating that he'll rip the science apart if Goodell doesn't accept Brady's denial.

The Union wants to show that as well, but it also wants to make the case that the League proceeded in an arbitrary manner with its investigation, used bogus scientific evidence to bring down one of its members and then set a precedent by excessively penalizing a team for the purported actions of a member of its union.

Those are different, but complementary agendas.

there is no solution here with Roger comes out the winner here, his only bet is to go all in and try and call brady's bluff.

People keep talking about what Goodell should make up in order to look good. Why not just tell the truth and admit Wells did a terrible job and there is nothing to support his conclusion.

Wells is not an idiot. He's one of the most successful litigators in the US with multiple big court victories notched on his gun. Like all big time litigators he "wins some and he loses some." He's wrong here, but he's not an idiot.

Exact same argument I made while they were preparing that report, and I also argued repeatedly that he would never risk his reputation by writing a completely biased and unsustainable report. I couldn't have been more wrong on all counts. Wells is a high priced shill who did as poor a job investigating and writing that report as could be done. He willingly damaged not only his reputation but that of his firm to do the NFL's bidding, and he did such a lousy job that it's doubtful the NFL will ever use him again either. So my conclusion is that he actually is an idiot, and his insistence that he was independent investigator after clearly doing the league office dirty work shows that he is actually a clueless idiot at that.

But we are talking about peoples advice to Goodell or opinion of how he should or will act based ipon his own self interest. Why would supporting a clearly stupid conclusion only to be proved wrong in court be best for him?

I suspect this is going to be more like a settlement conference than an appeal.

Kessler, "Hi Roger. We're going to kick your ass in court. But before we do, we're graciously giving you this final opportunity to come to your senses and back down. Any popularity hit you take now will pale in comparison to the consequences of court proceedings."

Actually, there's one kind of circumstance under which Brady might agree to a game of suspension in a settlement -- if part of the deal is to drastically reduce the team penalty, along with the league issuing a statement sharply circumscribing what the penalties are for.

• Non-cooperation? Unfair, but it can be a good business decision to settle about it.
• McNally taking the balls out of the referees' locker room? Technically, a violation.

If the league is clear that that is ALL the penalties are for, a settlement could actually happen.

That's what the Appeal will come down to. The texts, the long phone call and the meeting in the QB room. He has to convince Goodell that there is another explanation for all of that other than that TB knew about activities that broke the rules either before or as a result of those events.

Personally, I'm biased, but I think there is such an explanation. I think that he put a lot of heat on Jastremski and McNally to have the balls the way he liked them on game day. But, I don't think he ever told them to break the rules or knew they were breaking any rules if they were. I think he just states that as the truth.

The wrinkle is whether one or both of them told him they had broken the rules after the fact. Remember, neither of them had to go to Law School or pass an IQ test to get jobs as Equipment boys.

Brady wants to be able to stay away from the science unless he goes to Federal court. His agenda today is to convince Goodell that he's telling the truth.

Good. Maybe that means Wells does too, and we can find out why he didn't properly investigate the "11 of 12" leaker

These guys aren't idiots compared to the entire population at large. But in certain roles they can be intellectually inadequate for what they need to do.

The same is true of Roger Goodell himself. I am certain his intelligence is, strictly speaking, above the median for the entire US population.
