KDPP - spoliation of evidence can lead to the same sentence as the top count charged against the accused and if the act of spoliation was allegedly committed by the alleged perpetrator. Spoliation of evidence is a two-way street (both for those that are making a criminal or civil claim and for those that are having a criminal or civil claim made against them).

I think he did it. He got paid the big bucks and moved into a big house, with big cars and whatever the young and dumb waste their millions on. The local hommies contacted him about his old rivals trying to run his block, Hernandez went to show them who's boss. He'll likely play the season and be found guilty of 'something' early next year, even if its just the same BS charge Ray Lewis got off on. I'm not convinced one bit that he's innocent, no matter how much I love him.

It's been almost 48 hours. We all know what the facts are so far so no point recapping. UPCOMING SPECULATION FROM ME:

He's guilty. Either he was at the execution of this guy or he pulled the trigger himself. I keep finding myself coming back to "Why would you leave the body so close to your house?" Close to the ocean, a decent distance from mountains. Thats the only thing left I am wondering. Everyone on here calling things circumstantial are refusing to listen to their gut.

I am going to have a hard time cheering for this team if/while he is a part of it. Spygate/BB being a jerk to the media/media hate and complaining about us always winning is one thing. But paying a murderer $40M after this comes out doesn't sit right with me.

So when Hernandez is incarcerated in September awaiting trial, that won't concern you as a Patriots fan?

Nope not concerned at all. There will be some growing pains but we did fine last year and AH missed a bunch of games.
 
I just don't understand how someone can be living a life long dream/goal of many by playing in the NFL (not only that, but for the one & only New England Patriots) making millions of dollars a year, and fail to stay out of stupid trouble like this.

I was surprised (as I'm sure most people are) but because he genuinely seemed determined to win and work hard to get better, especially after that SuperBowl loss 1 & a half years ago. I'm pretty sure he even moved out to California for part of the offseason so he could practice with Brady and get better.

I really hope somehow he's on the field for us this season. If not (or either way) we better hope that other Aaron we signed today can impact the offense. (Dobson)

What kind of sentence would obstruction to justice be?
 
That is an interesting choice for a lawyer either it implies that this is not a violent crime criminal investation (toward AH) or he has had him for a while.

usually if something goes down and you are retained by the cops or whatever, you call whoever you know for counsel - your friend, attorney for a civil issue, whoever because you need representation immediately. And someone to make a statement to the media if you are famous, etc.

After the dust settles, you rethink it and hire a guy who does what you need. so it is possible he switches attorneys.

Pressure (peer, family, friend, societal) can be an amazing thing.

As I said before, Innocent until proven guilty. As someone who is trying to get into law enforcement and hopefully make detective...(note i am going by what the news is reporting) It is suspicious that Hernandez destroyed phones, erased surveillance tapes, and not cooperating with the police.

If Hernandez is guilty of the actual murder, he wont be on the football field anymore. If he is guilty of destroying evidence then depending on the laws of Massachusetts will depend on jail time. I need to check, but I think destroying evidence is a felony.

How can they prove that his stuff didn't break on accident, like say he dropped his phone and it smashed? Or do they not really need to prove that kind of thing?

The only facts I know are that there is a dead body and Hernandez's house was searched in connection with that. That's an awful lot of conjecture based on those "facts". I am not saying that I think Hernandez is innocent...far from it. But lets not confuse facts with conjecture.

As for my gut...my gut tells me that like many gang cases everyone is going to keep their mouth shut and a murderer won't be identified. There won't be enough to charge him with anything. My gut also suspects that Goodell will have enough to suspend him however and that will be enough for the Patriots to cut ties with him.

I am perplexed as to why the neighbors wouldn't call the police if they heard gun shots. Especially in an up scale neighborhood.
