Patriots' Hernandez questioned by police in homicide probe

Based on what Bedard has reported, I am much more concerned about Hernandez's knowledge of this crime and if these two guys were hiding at his house with Hernandez's knowledge of this crime.

Yeah, hiding his buddies, and if they are the murderers, makes this an incredibly bad situation for Hernandez.

Even if he had knowledge of the crime, so what? As long as he's not involved, it doesn't matter. It's not aiding and abetting until charges are filed, and that has not happened. Letting his buddies hang out at his house, even if they told him they killed a guy, is not a crime. Refusing to allow entry without a warrant is also not a crime.

Now let's just hope he's not involved.

It's so adorable how people are quoting lawyers when they say you should never talk to the police without a lawyer. What do you expect a lawyer to say? "Nah, you don't need to hire my services!"

With a crime this serious Hernandez is wise to get a lawyer. But he's also wise not to obstruct an investigation or hide perpetrators.

Despite what the police and governmnent like you to believe, there's a vast difference between "not cooperating" and "obstruction".

How so? No charges have been filed against them. They're not fugitives. Letting them crash at his place isn't illegal. It appears that they showed up with arrest warrants, went in, and got the guys. Either that or they consented to questioning.

Either way, everything's happening by the books. Hernandez has done nothing wrong in how he's handled the situation so far, based on what we've seen. As long as he's not involved in the crime, everything's fine.

I think you might be confused as to what "carnal knowledge" means:

Beyond that, no, you're wrong. We don't live in some giant honor system, where you're unilaterally obligated to tattle on everyone everytime you suspect that they may have committed a crime, at the risk of becoming a criminal yourself.

If I rent a car for my friend in my name, and he winds up dead, and I'm 100% innocent, 1) I let the cops do whatever they want in my house, even without a lawyer present 2) Be as cooperative as possible, hell I'm bending over backwards giving the cops any info I could think of to help their case.

Being uncooperative and making the cops get a search warrant certainly looks suspicious. I don't feel good about this. Reminds me of the days following OJ's wife's murder. OJ was a hero to me growing up, and felt sick to my stomach during those days, chase and all. Now I hate OJ.

No. You never talk to the police. Mainly because anything you say MAY incriminate you, so even if you're innocent, you may say something that can later hurt you. NEVER talk.

Nothing that Hernandez has done so far could be even remotely considered obstruction in court. There's no gray area there.

Because if 2 guys driving around in a rental in Hernandez' name shot someone and then were subsequently arrested at his house it's hard to imagine him not being involved in one way or another.

Has he broken any laws? That I don't know and won't guess at. But if he's let a couple of murderers hide out in his house knowing what they've done he's done wrong in my eyes. Still, I don't know the full story - maybe they weren't involved, maybe it was self defense, maybe they shot a guy who was raping kids.

This video absolutely captures exactly why you should never talk to police. Even well-meaning (and as someone who had a cop as one of the best men at his wedding I truly believe most are well-meaning) police can remember things wrong or make a mistake.

This URL can't be posted enough and I say that as someone who has, in the past, allowed police to search his car because I 'had nothing to hide'. Never again.

No no, I apologize if that was what it sounded like I meant. It's tough to comment on this with so many conflicting reports, but we've heard a report 2 guys were taken from his house in handcuffs. So if the cops were looking for suspects in a homicide, and you have those suspects in your house, and you are hiding those suspects, and you refuse to allow the police in the house, and you lie about them not being there, then yes that is obstruction.

It does not sound to me like that is what happened here but as mentioned, it is tough to discuss the situation with so many conflicting reports.

As long as he had no part in killing the guy, whether that part be being there when the murder happened, helping to plan the murder, etc. Hopefully, he didn't even know about it. This seems like the most plausible outcome, since only a colossally stupid person would execute a premeditated murder using their own rental car.

Even if his acquaintances killed someone, told him about it, and he told them to stay at his place, then they were taken into custody from his place until the police arrived with a warrant, there's nothing wrong with that. If anything, it made the police's job easier since they had a pretty easy time finding the guys.

So what you're saying is that, if I tell you that I murdered a hobo down by the train tracks in October of last year, and you don't turn me in to the police for having said that, you're now a criminal too?

If the murder was premeditated and he helped to plan it, then he's definitely in trouble. That's a separate issue, though.

Yeah, the only sensible thing to do is to listen to the police who are totally only there to help you.

Just ask them they can't lie to you, it's in the constitution.

I'll ask you the same question no one seems to want to answer:

Say you're in a bar and a woman tells the police you smacked her when you did no such thing (suppose for the sake of argument she got the wrong guy). So the cop comes up to ask you what's going on. Are you going to follow all this "never talk to the police without a lawyer" advice?
