But it doesn't give a hint of what is really the central issue, namely, what does it mean to abide by the CBA? In particular, is there a binding "law of the shop" separate from the plain text of the CBA?
  • Kessler's brief cites a whole lot of precedent for thinking there is.
  • Pash's brief cites a whole lot of precedents for thinking there isn't, most of which I imagine were considered and rejected as arguments against some of the precedents Kessler cites.
So it seems Volin still hasn't figured out what the case will hinge on (if not settled), which is whether Judge Berman will rule the same way on the same issues as Judge Doty and several other luminaries (and he would be within his legal rights to do otherwise, as none of those precedents seem to actually be binding on him).

If you are not a lawyer and specialize in labor law or the CBA it is very complex and confusing. I admit I get confused as well. Only way to get educated is to READ!

But Volin struggles to count the number of shoes he needs to put on in the morning - that's after he takes off his Batman slippers.

Volin is the worst type of journalist. He tries to pass opinions and biases as legitimate news reporting.
