Even if Heap were negligent in some way (which we don't know) and if he weren't paying attention, texting, not looking carefully, etc. who cares? All of us occasionally let our guard down from time to time if that is what happened. He was in his driveway, and clearly he had no idea. I assume my kids are inside all the time, and while I do try to check even if there's a .00001% chance I'm wrong, I don't examine every square inch, and I'm sure that when I'm moving my car or pulling into my driveway, naturally I start thinking about what I need to do next. Whatever happened - negligence or not - the loss here is so far beyond a proportionate punishment that it sickens me.
