Since that meeting could potentially affect Brady's case I think it would be worthwhile for Kessler to be present.

There is also no reason to trust Vincent or the NFL* and they should be watched closely.

The defamation card is the critical final step if we want these continuing attacks to end. Right now the common wisdom is that Brady got off on a technicality and the Pats beat the rap. Yes I would agree that this situation is very slowly changing as common sense and the facts rear their ugly heads, but it is STILL the pervasive opinion outside of NE. And it will likely continue to be, unless the NFL league office is exposed for the toxic waste dump it's become.

Now I would agree that nothing is likely to be done during the season for obvious reasons, but from what I've read here Brady et al have 3 years to file their case, so after the season ends, I hope Tom or Bob decide that their Legacy is more important than the effort it will take to mount their cases.

V, it will only be through a defamation suit that the NFL offices will be exposed and the truth behind these CONTINUING attacks on the Patriot's legacy will be laid bare and the attacks will stop. If you keep letting the bully take your lunch money, you should have no expectation of eating lunch. It is only when you stand up to the bully will the attacks stop. Unless you can give me another alternative, why would I expect these attacks to stop?

Hey Ken, I am totally on board with being disgusted about this whole witch hunt scam perpetrated by the league. I can tell you that I spent countless hours reading this forum (it was invaluable) during the spring/summer before I joined. I read every page of every report published so I get it.

Where we disagree is that I just don't believe the attacks will ever go away. How many times did you hear "but they have never won another SB since spygate?" It took winning another SB to tell them stfu. The thing is the haters are jealous of NE's success and I don't blame them. NE has dominated this league for the last 15 years not because of cheating but because we are fortunate enough to have 1 outstanding coach and 1 outstanding QB during that time and no other team can make that claim. I think the League is already exposed, more and more of the people that count (players, coaches, executives, media, and even fans) are realizing that this whole thing was a scam. But you will never ever convince the haters. They have no choice but to hate because their teams suck. It is pathetically sad to be in their place and I for one will not spend an ounce of my precious time on this planet trying to convince them otherwise.

My God, the level of incompetency of the NFL league office never ceases to amaze me. These idiots don't seem to understand that by asking these 2 guys in, they just made a liar (what a shock) out of Roger Goodell, who told the world the league never suspended them.

This is great news for these guys, however, since unless they are being brought in for an apology, it only strengthens their defamation or wrongful firing suit, (whichever they decide to file).

IIRC these guys where subject to multiple interviews totaling over 7 hours of testimony. Testimony that even the biased Welles couldn't use to sink the Pats. IIRC, he only use one or two SENTENCES in his report. That's one or two sentences out of over SEVEN hours of combined testimony. Clearly McNally and Jastremsky have nothing to add to this, and by so publicly calling for their presence the NFL is merely attempting to prolong their media attack on the Pats and to further humiliate these 2 poor powerless guys.

Just another example of the lengths the NFL is willing to take this against the Pats (Take note Bob), and how Toxic the leadership is at 354 Park Ave has become.

Also, it continues to detract attention from the games now that the season has started. They should be lawyered up and refuse to participate if it turns out to be a cross examination session based on Wells, unless they're allowed access to Wells transcript. And, it should all be on the public record. We all saw how bad the NFL looked when Judge Berman made public the NFL transcripts.

No one is suing anyone. This legal lawyerey BS is over. Brady had no choice but to sue to defend himself, it was within his rights. The NFL foolishly is continuing the appeal process but once done that is it, the end.

Put yourself in the position of McNAlly or Jastrewski. They have been publicly slandered, libeled, defamed and lost their jobs. A cause of action for either defamation or wrongful termination may be their only way to clear their names and compensate them for what they have suffered. The attacks are like those of a bully. You're right that they won't go away UNLESS you stand up to the bully.. A lawsuit with another stinging loss for the league may cause a few more owners to claim "enough" and get the unfounded attacks to stop.....if only for the PR hits that the league is taking.

Different purposes come to mind for this meeting:

• Vincent will allow their reinstatement under the condition that they waive their right to litigate
• Vincent wants to make clear that it was the NEP that suspended them and that they had nothing to do with it
• He wants to catch them saying something new
• In a tit-for-tat with the NEP office, he wants that last interview that the NEP office denied the League office from having

I'm not a lawyer so I can't comment on what kind of a case they may or not have regarding defamation or wrongful termination. I live in a "right to work" state so pretty much you can be let go for any or no reason at all here. As far as clearing their names, I think they are F***ng HEROES. I suspect most in NE feel the same way.

Kessler and his firm would likely be conflicted out, anyways. J&M's interests do not align with and could in theory be adverse to Brady/union's interests.

You are confusing "right to work" with "at will employment". Right to work means that you can't be forced to join a union as a condition of employment. At will means that absent a contract you or the employer can terminate the employment at any time for any reason (except for reasons pertaining to protected classes/categories). Most (all?) states are at will.

Not a lawyer but imo taking on the behemoth of the league office will be a huge up hill battle resource wise.
Not that they can't be beat, we've seen how incompetent they are but it will take millions to put up a fight. The NFL will just drown them in motions.

If the NFL does try this power move with them, it is a lose-lose for them. They cannot get re-instated if they don't admit to the Wells Report, but how long can they expect to stay employed with the Patriots if they do?

But this seems clear that they want to win the PR battle by getting these two low level guys to admit that Brady is a liar and the Wells Report is right.

Yep they are 100% not being reinstated by the nfl unless they accept the report. I also think vincent will be coached up to fish for something from them that could allow the nfl to punish Brady even if it is a tiny violation that is only finable.

Thanks for the clarification. I live in Florida, its a right to work state. Maybe its also an "at will" state? I don't know but labor laws here suck, they don't need a reason to let you go, short of discrimination of course.

I hope you are wrong. I don't see what reason they would have. Vincent's letter was specific to what they would not be allowed to do after reinstatement. So the letter itself implies reinstatement is possible. Like you I don't trust the NFL but I think they would look worse by not reinstating them (being vindictive, sore losers, picking on the little guy, etc.).
