Patriots' Hernandez questioned by police in homicide probe

Yes it is true one stupid word can potentially cost you a suspension or being cut by the team.

And you know what? Refusing to cooperate with the police can also potentially cost you a suspension or being cut from the team.

Are you ever going to stop with this one way **** measuring contest you have going on?

I've read this suggestion on another board, and it sounds somewhat plausible: that the victim was using the car rented out in Hernandez' name and went to the business park to meet someone for a drug deal or whatever, something bad goes down, victim gets shot when he's out of his car, and the shooter(s) drive off. Thoughts?

Not just plausible, I'd imagine that's the most likely scenario here. IMO having a victim (and a friend) laying right next to your car makes you one of the least likely to be involved because nobody would be that stupid to plan out a murder like that.

If an NFL player - or any worker - could be suspended from work for exercising his Constitutional rights under the 5th amendment, we'd see a massive blowback from labor. That's a truly chilling scenario.

Doctors have to report gunshot wounds to the police. So if Aaron told the guy "don't call the police" it wouldn't have done him any good AND would have done him a whole lotta bad. It would have opened him to all kinds of legal headaches. Witness tampering, etc.

I'm going with theory that the victim in that just wanted a mega-payday and wrongly accused AHern, then got laughed out of court, or dropped it after AHern's lawyer informed what a truly bad idea a frivolous suit against his client could be.

(That's if this lawsuit story is even legit. TMZ ain't exactly the NY Times or Washington Post.)

Or the guy could've went to the hospital and told police he doesn't know who shot him. He would have still been treated and the criminal case would have fizzled out.

And, it doesn't matter that it's TMZ reporting the lawsuit, more reputable sources have also confirmed the lawsuit exists.

Although we are getting way ahead of ourselves here, I am sure the Pats have a morals clause in the contract where they will be able to recoup the signing bonus which I think gives them back at least part of the cap money. I could be wrong about the cap money, but they certainly will be able to go after Hernandez's bonus if he is charged with murder.
I believe these things are covered by the CBA. I do not think the Patriots have any recourse to get his signing bonus back if he shows up to play. Now, if he's in jail, then I believe they do. But they can't cut him and try to get his signing bonus back on some sort of "morals clause."

They - or the league for that matter - can certainly suspend him. But even with a suspension, I don't think they can go after the signing bonus.

The current reports could not be more conflicting if they tried

CBS says he is not cooperating and has not been ruled out as a suspect

ABC says he has cooperated and is not believed to be a suspect

an important omission: a dismissed CIVIL lawsuit.

Why were there never any criminal charges, if he shot somebody in the face?

sounds sketchy
That was my thought too. If the lawsuit said "Aaron Hernandez punched me" well then that's believable. But to say "Aaron Hernandez SHOT me" is a whole other story since any shooting would have a criminal investigation.

Hernandez just signed a new contract. As a matter of pure speculation, if he were released, how much would Kraft be in for and what would be the implications for the salary cap?

FYI - The numbers on my cap page - Miguel's UNOFFICIAL 2013 Patriots Salary Cap Information Page presume that the player would be cut, waived or traded.

They do not presume that the player would invoke this clause

"Forfeitable Breach. Any player who (i) willfully fails to report, practice
or play with the result that the player's ability to fully participate and contribute to the team is substantially undermined (for example, without limitation, holding out or leaving the squad absent a showing of extreme personal hardship); or (ii) is unavailable to the team due to conduct by him that results in his incarceration; or (iii) is unavailable to the team due to a nonfootball injury that resulted from a material breach of Paragraph 3 of
his NFL Player Contract; or (iv) voluntarily retires (collectively, any "Forfeitable Breach") may be required to forfeit signing bonus, roster bonus, option bonus and/or reporting bonus, and no other Salary, for each League year in which a Forfeitable Breach occurs (collectively, "Forfeitable Salary Allocations"), as set forth below.

If you want to learn more about the forfeitable breach clause I recommend reading pages 27 through 31 of the CBA - http://www.patscap.com/2011cba.pdf

Which loses his lawsuit a lot of credibility if that was the case.

man everyones ready to hang the guy. Their girlfriends are sisters, he's probably friends with him, could have been hanging out, borrowed AH's car to go out somewhere, drug deal or even just to get a pizza, had a large wad of cash that the wrong people saw, and he got followed/robbed/killed and AH is totally innocent and clueless to the whole situation.

At least thats what I'm holding out hope for and is actually much more likely then AH is stupid enough to kill someone that connected to him 1 mile from his home in a car that's in his own name.
Here's my theory (and, unlike my other posts in this thread, this post is just speculation): Hernandez got the car in his name since he has the most money and presumably has a good credit card which you need to rent a car. His buddies were using the car and something went down, perhaps a drug deal gone wrong and things escalated to the point where someone was shot. The buddies immediately went to Hernandez, the police arrived, etc. I'm hoping this theory is the correct one because it implies no direct involvement by Hernandez.

I also have an alternate theory that involves the girlfriends.... maybe the victim was guilty of domestic violence, smackin' his girlfriend around..... maybe Hernandez and co. decided to take matters into their own hands and get a little revenge, and things escalated out of control. What was supposed to be a little beatdown ended up in a shooting.... This theory scares the heck out of me because that means Hernandez has direct involvement.

Just throwing those out there - enjoy!

As others in here have pointed out, you don't need to be convicted of a crime to be suspended in the Goodell Football League. Goodell will do whatever the heck he wants and the powerless NFLPA will do nothing to stop him.

I like the KISS principle in conjecturing about this sort of thing with no facts to go on.

Dude gets in a fight with his girl (AHERN's girlfriend's sister) while the girl is driving her sister's leased car (leased in AHERN's name for HIS girlfriend). Girlfriend grabs dude's gun and puts a hole in his head. Panics. Dumps the body, leaves the car, and walks home. Lover's quarrel, crime of passion, is usually how these things play out.

If that turns out to be the case, then AH better quit farting around and speak up before he gets charged with accessory after the fact. That doesn't quite get him out of the woods yet.

I'm thinking a more likely scenario is closer to your first one that his "friend" borrowed the car (which I don't understand why a car rental was warranted in his name since he lived there and likely has more than one) and got into some shady deal that went bad. With any luck, the dude simply ran off leaving a VERY surprised AH answering the door with cops on his doorstep.

Tell that to Jonathan Vilma. . . .

According to "people close to Hernandez" there were concerns that he had recently become involved again with the gang which had been involved with before going to Florida.

If this news is true....

We're talking about off field disciplinary issues here, not on field, game related activity. When it comes to the Ben Roethlisberger's and PacMan Jones' of football, as others in here have pointed out, Goodell gets to do what he wants.

Christ. This is starting to get really really really troubling.

I really hope he had no involvement here. Wayyy too much time to speculate with no football activities.

unless those "people" start giving out their names Keep that nonsense out of here.
