Hm, even if it's not McCoy's fault can we still claim that both parties look bad?Pressing charges would have created a huge headache for the city because the evidence seemed inconclusive and indeed based on released witness statements there was a good chance the off-duty cops actually started it. And McCoy has the resources to mount a vigorous defense that could have cost the city quite a bit of money and ended up embarrassing the city and its police force.

Absolutely we can claim that. Fighting, as an adult, looks bad.
Off duty officers who have their guns on them in a club at 3 am looks pretty bad. In fact, civilians (which you are as a cop when you're off duty) aren't allowed to have guns in a nightclub. It also looks bad to start ****, get your ass kicked, and then hide behind your badge when you weren't on duty. Should be dropped.

FWIW, many cities require that their police have the firearms and badges with them at all times. It's for the cop's personal protection in case someone decides they recognize them and want to "do something about it", and also so they can respond if there is an incident nearby.

What charge could McCoy press on who?The prosecution would have cost the city money, and McCoy could have pressed charges himself if so inclined.
