Also i heard on the radio that generally the clerks write the decision(under direction of the judge) and then the judge edits and makes changes to it where he thinks he needs it. This almost all of us knew, the next part was news to me.

It seems though at the end of Aug/beginning of Sept is when the clerks switch out (The clerks tend to be recent graduates that for 1 year do the job for experience).

So basically it is possible he just got brand new clerks who have never done this before so he will need to do a lot of extra editing or write the whole thing himself.

Again, just what i heard so take it with a grain of salt.

I'm in agreement with the line of thinking that the Judge wants to make his ruling as difficult to appeal as possible.

I'd be stunned if he does not rule in Brady's favor based on everything we've seen and heard.

I doubt he is ****ing around for attention probably just making his decision air tight in regards to an appeal.

Yeah, his job isn't easy. And he very likely is hearing a number of other cases at the same time. One doesn't become a federal judge for celebrity.

Brady exonerated, suspension erased, NFL berated by judge

Federal Judge Richard Berman vacated the suspension of Tom Brady, citing numerous violations of the Federal Arbitration Act and of the NFL’s own collective bargaining agreement. He cited as factors in his ruling the lack of neutrality and fundamental fairness on the part of the arbitrator Roger Goodell, the lack of notice given to Mr. Brady, and the decision of the arbitrator to deny Mr. Brady’s legal team the opportunity to review the investigative materials of the Wells team and to interrogate the Wells report co-author Jeffrey Pash. Judge Berman also cited the inconsistency of punishments by the NFL for specific violations whose penalties have been collectively bargained, emphasizing that the allegations against Mr. Brady are best categorized as equipment code violations rather than being charges similar to violations of the NFL’s substance abuse policy, as Goodell had argued.

Mr. Goodell’s arbitration ruling was discarded, and the issue of lack of notice, which cannot be remedied, renders the dispute not open to re-arbitration. Mr. Brady will be available for the season-opening game next Thursday, September 10.

While Judge Berman explained that his ruling was based upon the issues of arbitrator fairness and CBA compliance, in a stern rebuke he also noted that throughout the entire process of their investigation the NFL had in his opinion willfully ignored exonerating evidence and data, had played a role in allowing false information to drive the public debate, and had generally engaged in a clumsy and fundamentally biased rush to judgement.

An NFL spokesman indicated that the league plans to appeal the verdict.

It gonna come down today, if it doesn't then I have no choice but to assume the judge is ****ing around and looking for some kind of attention.

I don't know when he will rule, but I am pretty darn sure the last thing Berman is seeking is the attention that would come from delaying getting a case out of his courtroom that he never wanted there in the first place. Now, you are 100% right that Goodell was betting on getting a judge who was looking for attention and getting on the front page of the tabloids, but he got the wrong judge, he got a guy who had no time for his nonsense. That doesn't say how he'll rule, just that Brady got a fair hearing from him.

Berman is taking his time because he wants to get this right. It's very likely that this decision will be one of the most read court decisions of the year, trailing only the Supreme Court's decisions on the Affordable Care Act and Marriage Equality. I am okay with him taking his time. I just hope that it is to release an ironclad decision in favor of Brady.

For him to write a decision that is going to stand up on appeal for Brady, he needs to write a sounder, more researched document.

Hell, even Roger Cossack broke from the ESPN legal "experts" talking points of this case being a slam dunk for the NFL to admit the delay in the release of the decision probably points to the fact that Judge Berman is going to over turn Goodell's appeal decision. At least I think that is what Cosack said. He was stumbling over his words so much because he knew he was pissing off the ESPN higher ups by saying Brady might win that he barely made sense.

The NFL has officially turned in it's appeal. After much discussion, the courts will now announce the judge of the NFL's appeal.

I get the feeling that Cossack is actually respected by his peers but is still an ESPN cronie to some degree... I think at the moment he's stuck between pleasing his Worldwide Leader Overlords and actually saying something that makes sense.
