Maybe not willing but why not able? I seriously doubt there's anything in his owner's agreement waiving his right to sue for intentional tort.

I'd expect just the opposite - that the owners' agreement prohibits suits for everything other than what the law prevents from being prohibited.

I believe judges can also issue a ruling pending a formal opinion. So Berman could give his ruling even if the written opinion isn't done yet.

If I was Brady, here is what I would offer:

1. An admittance that I did nothing wrong, nor is there any proof that I did.
2. An admittance that my phone is my personal property and the league has no right to the contents on it.
3. Goodell's, Vincent's, Pash's and Kensil's (among others) immediate resignations and admittance of a conspiracy.
4. Federal RICO charges against the conspirators as well loss of the Antitrust Exemption for the NFL.
5. A promise that I will sue for defamation.

Let's apply that same logic to Jim Irsay. After all, it's been more than suggested that he's a drug addict and has participated in the illegal purchase of controlled substances.

I doubt he has the cajones to show his face in Foxboro. I would hope that if he does show up, Kraft lets him sit with the fans rather than cosing up with him in the owners box as if they were best friends as I fear.

My understanding was wells also said 'I don't need/want your phone - just give me any relevant texts'
If you couple that with no warning of a penalty, you can come to the same conclusion as you would if he said 'I won't penalize you for not handing over.'

But this whole phone thing is all just a red herring anyway. They threw the phone charge on at the end after the wells report was all done and in the appeal phase. Essentially they realized they had nothing, but figured they could convince joe public he was guilty of something if they used the fact that he SWITCHED his phone to smear-incriminate him with 'he destroyed his phone.'

AND.....guess what? It worked so well we even have posters on this board nonchalantly throwing around NYJFL propaganda by using the word "destroy" in this very thread. (ASHAMED? ANY OF YOU?)

Brady has a great case for defamation.

this alone should force the league to drop all of this and move on with the actual season of football.

Yes, he made that compromise offer, but he didn't say that there would be no penalty if that offer were to be rejected. OTOH, he also didn't say that there would be a penalty if the offer were to be rejected.

Actually RK did not originally want Goodell, he backed another guy (name escapes me) Once he saw the majority was behind Goodell he went along with it. He did back him in the Ray Rice fiasco and that was the chance to kick his ass out so RK's responsible for that.

You are both at least partially right (cmass, you are right, but joe6's thoughts still apply as below) .

Go-to-hell sure wasn't RK's choice at the initial hire, but RK sure pushed his weight around to REHIRE/EXTEND the clown, and that was AFTER 2007-camera-gate. Some of the other owners were fence-sitting about going thru a new selection vetting process, and bob went national press to say way a great job he was doing.

I couldn't believe it then, and based on that I can't fault anyone who says bob only has himself to blame for deflate gate

There's no viable settlement because the NFL insists upon Brady admitting complicity and Brady is never going to admit to doing something he didn't do.

For those disagreeing (not that I care about being disagreed with, just commenting), I'm not saying it's fair but this thread is about a settlement. A settlement of no suspension, 50K fine and an ESPN interview declaring innocence isn't going to happen. A settlement = you give something up.

Dont settle. A four game suspension with no admission of guilt lasts a season. A settlement (essentially admitting guilt), last FOREVER!!. I don't see TB doing that. And I hope he doesn't.
