  • The whole thing is stupid and Berman's probably really annoyed it ended up in his lap.
  • He was not surprised Berman was asking questions about facts. Said no actual litigator would be surprised by that. (Mrowr!)
  • Berman hammered Nash.
  • Gave Nash credit for not dancing around the lack of direct evidence.
  • Brady's side shouldn't get too ****y.
  • Brady would be silly to file a defamation suit.
 
I'll be really interested to read the brief Kessler submits tomorrow. Dale and Holley spent a lot of time today talking about whether Berman acknowledges the science because Berman seemed to think someone did let air out of the balls. I wonder if Kessler will deal with that at all since he didn't seem to challenge the judge's comments. At least publically.

According to multiple reporters who were in the room, Kessler actually did challenge the assumption that somebody deflated the footballs. His whole response didn't fit into 140 characters.

Seemed to me like he danced an awful lot until the questions forced him to stand still, but what do I know?

Yes, Kessler said, "we don't believe anything happened" before he said if anything did McNally acted alone. I still thought the response was a bit tepid. Perhaps he just felt it better not to go there. Or maybe he and Berman discussed it on the robing room. The judge still seems skeptical, so I just wondered if he'd broach the subject again.
