Judge Berman continues to encouragement-Next meeting Aug 31st

Raise your hand if this somehow makes you hate Goodell even more.
Never healthy to hate but I'm close.

This will go on until either Goodell gets a contionual amendment that he can do whatever he wants or Brady gets one that he cannot be punished for a crime with zero evidence.

I don't think it's possible for me to hate Goodell even more but I'm starting to hate Berman. One side is calling the other a cheat and a liar on no evidence and the other is denying everything. Where exactly is the middle ground on which Berman expects them to compromise? Don't say "the non-co-operation" because if that is the sole basis for settlement then it all becomes a conspiracy without a crime. It's past time for Berman to stop ****yfooting around with hinting both sides toward settlement and just do his job.

He's doing his job and perhaps helping Brady along the way. If he doesn't handle the appeal the right way, that could give the NFL more ammo at their appeal (2nd circuit).

Who doesn't want this to be done with, but I want Brady to get the best result he can (even if that means having to continue to be anxiously patient with the system).

I thought armchair GM's were bad, but armchair Judges might be even worst. Stop acting like you know how to make judicial decisions. How could anyone start to hate Berman?
 
I can understand Berman urging settlement. In the grand scheme of things, ball deflation issues shouldn't be clogging up our judicial system. There are much more important things to be adjudicated. Hence, why Berman is urging a settlement.

But it isn't a ball deflation issue, it is a union workers rights that are on trial here.
This case WILL set precedent.
I assume Berman wants a settlement so he is not subject to appeal. Both parties seem fervent to appeal a loss, and judges don't like their decisions put under that scrutiny.

There have been many non-NFL union workers' rights cases decided. This will only really set precedent in regards to the NFL in particular and maybe sports leagues more broadly. I know judges do not like being overturned on appeal, but the SDNY judges also have really busy dockets, and this seems to me to be on the bottom of so-called importance (i.e. murder cases, etc.)

I think Berman's pushing for a settlement because he knows that if he has to rule on this it'll be appealed. He thinks this is a waste of his time, and for it to end up in front of the second circuit court of appeals would be yet another waste of another court's time. He recognizes that the only way to avoid that is for a settlement to be reached.

That's what he wants. Doesn't necessarily mean that he believes it'll happen. But he's going to push for it until it becomes clear that it won't happen, and when that becomes clear he'll make his ruling.

It also means that when it is appealed the appellate court will know he did his best to keep it from being on their docket. Makes them more sympathetic to his plight, and thus perhaps more likely to sustain.
