Holland vs. Munson

Thanks. Love that he pointed out that Munson 1) has been Super wrong before on big cases and 2) hasn't been a practicing attorney since the 90's.

Not only is he not a practicing attorney, but he was forced to resign for ripping off his clients. Google it.

Yes I had seen that he was disbarred. Didn't care enough to find out at the time. Interesting to know now, thanks.

Munson thinks RG's 20 page appeal BS is comparable to Victor Hugo or Hemingway...

Berman is attacking the NFL's case because he knows that only way to get a settlement is to attack the side that has the strongest argument.

Yeah, Munson said that.

and as if on cue after seeing this thread and looked up at the headlines and one of them is

Munson: Wackiness is all part of the judge's plan.

clicked the link and the headline is

Don't be fooled by judge in Deflategate case; NFL will win in end over Brady

He is sure the judge has already ruled
Told Brady supporters to not look into how he is acting because every judge ridicules the side with the "stronger" position
Brady's legal position is very weak
According to him the law prohibits Berman from ruling against the nfl
Says that Brady's "awkward and unsuccessful attempt" to cover it up proves he got notice.
NFLPA filing 4000 pages of transcripts, exhibits, and documents is a show of weakness
Trying to convince the judge that the commissioner of the most successful sports league would deliberately slander and smear a player is sign of a very weak case
Also cites the Garvey/MLB case

Baghdad Bob was more believable than Munson.

These are mostly ad hominem arguments against his article. He's not saying anything we haven't already said here, it's not crazy at all what he's saying. That is, Berman's hands are tied for the most part legally speaking, and there is a good chance he sides with the NFL even though he realizes it is ridiculous. Of course there are other options, but this is one main option.

The Garvey case should give us all pause, no?

Ordinarily I might agree but, in this case, that's all Munson really deserves.

Of course it's possible the NFL might win. But to making a categorical argument to that effect, given all that we've seen and heard, is beyond ridiculous unless you are a.) dumb, b.) peddling an agenda or c.) both.

This was the winner.

It is difficult, if not impossible, to think that Brady could not have known that deflating game balls below the minimum required pressure did not affect the integrity of the competition. His awkward and unsuccessful attempt to cover up what happened show that he had "notice" that there would be a problem

Did TB sleep with his wife?

Regarding it, the article says:
Garvey had gone to federal court to challenge an arbitrator's adverse ruling in his claim for $3 million in damages he thought he suffered during the MLB collusion conspiracy of 1985-87. He wanted the federal courts to reconsider the arbitrator's ruling.

Sound familiar?

The nation's highest court ruled that even when an arbitrator's decision was "improvident or even silly," it does "not provide a basis for a court to refuse to enforce the award." Even when the federal judge considering the arbitration award is "convinced that the arbitrator committed serious error, it does not suffice to overturn [the arbitrator's] decision," the court ruled.

This was a unanimous declaration by SCOTUS. Those saying you are not bothered by this....Why?

It's like being on this forum the day before the Wells report was released, when we were all riding unicorns on top of rainbows because Wells was going to eviscerate the unprofessional sting operation and totally exonerate Brady (E.g., see palm beach pats fans prediction thread about what the Wells report would say). People are slowly, inexorably, becoming unjustifiably optimistic again.

Stop.

Be pessimistic, or there will be much wailing and gnashing of teeth.

any professional who is a tv "expert" has to be questioned.

Really, if you're that good of a legal mind, why wouldn't you be practicing, instead of writing for BSPN?

It's like the old adage says....

Those that can, do. Those that can't, teach (or work for BSPN)
