I was reading the boards last night and noticed some Jet threads and certain individual posts taking the moral high ground, so I concocted this scenario into a semi-plausible "investigative" foray and immediately got an outrayged response. Passed the rest of the night having a chuckle at his expense.

I know it's easy to get defensive when you start debating someone on a messageboard, but sometimes one needs to step back and admit they wrote something stupid. Your narrative was beyond stupid. Even Edelman's defense attorney wouldn't come up with something so outlandish. We all know false accusations sometimes happen, but to come to the "possible" story you came up with requires either being drunk or beyond obstinate. And then calling a random guy after misreading a police report? C'monn, you have to be able to laugh at yourself with a name like Joker.

This "innocent until proven guilty" concept isn't a fiction. It's a legal concept put in place to protect people from being thrown in prison without getting a fair trial. It is based on gathering testimony and PROOF before determining guilt so that makes it pretty realistic in my book.

Well, it's real in a courtroom and in other legal contexts but doesn't have much reality beyond that. All it says, as you know, is that the defendant is presumed to be innocent and to be convicted the prosecution must prove all the elements of the crime beyond a reasonable doubt.

It doesn't mean that we, the general public, have to apply any presumption of innocence whatsoever. And in some cases it would be incredibly stupid for us to. Say there was incontrovertible evidence of X committing a crime (say he videotaped himself doing it), but the cops failed to get a warrant, so the evidence was suppressed, and without that evidence the prosecution couldn't make the burden of proof and X was acquitted. He would be legally innocent, but the actual, real world truth is that he did it.
