I'm being picky because it seems like an incredibly central point.

It seem crystal clear. We know now not even the Patriots or Colts knew the true PSI and the only ones who knew were League employees. Mortensen said he spoke to multiple sources. So unless the NFL can prove Mort made up the story, I think it will be tough for the League to convince a judge or jury that they are not a source in a civil case. In a criminal case, they might be safe.
 
I assume it's Munson you're talking about. One problem with Munson -- he doesn't understand the science. As I said in another thread, if the real PSIs had been released, simple IDL science would have explained everything and the whole thing would have blown over. Wells/Exponent came up with a convoluted/complicated report to try to show the balls were deflated and Munson (and much of the public) accepts it.

I guess that's not all with Munson -- there is a lot of innuendo (Brady signing things for MacNally MUST be payment for deflating of footballs, for example). It's not well written, as Munson says, so maybe I'm giving him too much credit.

I've actually researched the most recent NFL player to file a defamation lawsuit against the NFL (actually it was filed against Goodell), our old friend Jonathan Vilma.

He lost. The case was dismissed. The reason why the case was dismissed, however, is very interesting. If I understand it correctly, he sued Roger Goodell individually (not the league) and the case was dismissed because the judge ruled that Goodell's statements were made in an official capacity. The judge wrote:

"The Court finds that all of the allegedly offensive statements were made by Goodell as Commissioner of the NFL in conjunction with the investigation resulting in the now well-known discipline against Vilma and others associated with the Saints.''

There was also some question regarding whether or not Goodell's statements about Vilma were actually accurate.

For Brady, we know 2 things: (1) The "11/12 balls" statement is totally inaccurate, and (2) That statement was not made in any official capacity whatsoever.

Maybe Brady could go after Kensil?

Yeah we really could not catch a break. RG hid under the robes of the commissioner, careful to attack the Saints, coaches and players in only an official capacity.

Making random put down statements where RG was amazing asked only questions where he had a chance to say what a good guy he was for catch this cheating and deplorable organization before they killed again. It was a circus, and we just watched as the clowns had a field day at our expense.

But the Judge made the right ruling, by law. Though whats never brought up is what he said after the ruling.

"Vilma's argument that the statements were made in Goodell's individual capacity is unpersuasive as Goodell was sued as Commissioner of the NFL and all of the statements attributed to Goodell were made in connection with the NFL's investigation of the pay-per-performance/bounty allegations," Berrigan wrote in her ruling. "Therefore, Vilma's claims are preempted and must be dismissed.

"While the Court is extremely disturbed by the fundamental lack of due process in Goodell's denying the players the identities of and the right to confront their accusers, that was substantially rectified later in the process," Berrigan added. "So while the process was initially procedurally flawed, the statements were ultimately found to have enough support to defeat the defamation claims.”

Berrigan ended her decision by writing: "Even though this matter has been pending only since May of this year, it feels as protracted and painful as the Saints season itself, and calls for closure. The Court nonetheless believes that had this matter been handled in a less heavy handed way, with greater fairness toward the players and the pressures they face, this litigation and the related cases would not have been necessary.”

We think that Vilma’s lawyers must have known that this would be the ruling, and that Vilma continued the case just to piss RG off, and show in a court of law that the evidence, process, and persecution of RG and the NFL was flawed,without merit, and would never stand up in court.

In the end nothing mattered and the damage was done.

If any statement was made by RG or Kensil in a unofficial statement, ID say he might have a good chance. Brady needs to fight this for everyone, so what happened to the Saints wont be allowed to happen again. I have faith in Brady, hes a good man and smart.
