If I may respond to my own post...If you are drunk, a defense attorney would advise not to take the sobriety test. In many states that results in an automatic suspension of your license, but that is a small price to pay in exchange for reasonable doubt. And yes I know they can compel a blood draw later on, but that takes hours and creates problems of its own. Often such blood draws and not admissible.
It turns out the above is pretty much what happened. He refused the sobriety test on scene but blood was drawn.
I sure as hell hope the authorities who drew the blood crossed all their t's and dotted all their i's. I want this POS to go down for as long as possible.
