'LeMon says money isn’t the object of the February suit he and three others filed, which alleges fraud by NFL officials. It seeks only $75,000, which LeMon said would go to charity.

“The purpose of the lawsuit is not to get some minuscule amount of money. They won’t even notice that,” LeMon said. “It’s to get at the truth.”

LeMon said that by seeking $75,000 in damages, he keeps the suit below a threshold that could result in it begin transferred to federal court, as other suits have been.

“I feel that their record in the federal courts is way too good,” he said. He also wants the case tried under Louisiana law and jurisprudence, he said.

LeMon said he wants what he describes as a “mountain” of evidence in the case. He said he wants to know, among other things, whether the officials involved in the play were disciplined for not throwing a flag. “I want their personnel files. I want their gradings,” he said. “I want their notes from the game.” '

Some random thoughts;
1) Smart move keeping the threshold low to keep it in state court (home cooking)
2) Discovery of documents should be interesting, especially if they can prove the league didn't turn over everything...
3) Goodell was deposed before in Kaepernick case but as anyone who has been deposed can tell you,it isn't fun when a skilled interrogator is going after you..
4) I can envision the league telling the Saints to find a way to make this disappear or Super Bowls won't be coming to New Orleans any more......
5) This is kind of stupid and bad precedent but I kind of enjoy watching the league squirm. As the expression goes, " ain't no fun when the deer has the gun."....

I don’t think anyone in the League is saying they didn’t mess up.

I think the best defense - beyond the plaintiff’s lack of standing - is that bad calls are simply a part of the game, and everyone knows it. It’s a risk you accept when you watch a contest.

Colin Kaepernick said no to a contract offer and then sued the NYFL for collusion and won. Being offered a contract didn't hurt his argument.

Some little Jete fan puke tried to sue the Patriots in 2007 in the same grounds after Cameragate. The judge ruled the case would not be heard because fans are not entitled to a fair game. Even if if a game is fixed, thrown, or whatever, there is no grounds for a lawsuit. A ticket holding fan is merely entitled to watch the game, whatever the circumstances or fairness. Otherwise, can you imagine how many people would have won these in the past? There’s the FIFA match fixing, Tim Donaghy (who outright gave the Lakers that win over the Kings and admitted it, due to blackmail), Bill Levy (Steelers homer who reffed SB40), boxers taking dives, point shaving scandals by the players themselves, Pete Rose allegedly betting on games while being the manager, PED scandals. Beyond just sports, many pay-to-see entertainment competitions are rigged.

I hate the NYJFL as much as anyone, but the judge in this case should be dis-barred. This is completely against all prior precedent and could lead to bad future consequences of other cases getting standing. I’m not sure if the NYJFL can appeal this decision for the case to have standing.

1) It was a crap non-call that MAY have influenced the outcome of the game.
2) Saints still had every opportunity to win the game and advance to the Super Bowl but they didn't. After all, I heard that receiving the ball first in OT is basically a free ticket to victory.
3) This sets a terrible precedent and now your average NFL dimwit fan with an IQ hovering around 80 will try to sue for any controversial call.

Have you really thought through the consequences of what you hope happens? If, by some miracle, this guy wins (which he won’t) is this something you really want in the sporting world? Fan lawsuits over bad calls?

By “cause of action,” I mean what legal theories are the plaintiffs relying on in their lawsuit? I just read they are suing for fraud, unjust enrichment, and “detrimental reliance.” It seems to me that they’d have a better case for proving negligence - that the officials were negligent in their officiating of the game. Fraud would require some sort of intent, which the league can just dismiss as a screw up that happens from time to time.

The rules are the officials call stands and there exists no mechanism to overrule it.

Agreed. I don't understand this, or why this is a bad thing for Roger or the NFL. Even if the ref testifies that he didn't see PI, and Roger testifies that it was a bad call, what then? They can't overturn it. Bad calls happen in sports *all the time*. So Roger says yeah it was a missed call, we spoke to the ref about it, and we're working to get better for 2019.

What happens after that? What's the "verdict" going to be?

Yeah, this is a silly use of resources and a terrible precedent.

It isn't just the Louisiana is grossly underdeveloped in education, infrastructure, health care, etc. It's that the entire city of NO only has at most 25 years to exist where it is currently located. The idea that building more and bigger walls is a solution is mind-numbingly stupid. But heck, let's use our time and money litigating moments in sporting events.

Not to get off topic, but, uh, what do you suggest as a solution? Do you expect them to up and move a metro area of nearly 1.3 million people and abandon all those buildings?
