The whistle isn't some magic "excuse all violence" thing. Doesn't matter if it hadn't blown. (1) The player was clearly OOB and (2) head shots are illegal before or after the whistle.

Evans intent was clear as he ran clear across the field to bury a guy from behind, jumped on top and threw punches
Gronk's frustration and loss of control was clear, and his intent was to jump on a player that was on the ground (whether he knew he was 'down', despite the big white line, is questionable in the circumstances, my guess is the kid was seeing red at that point)......but the intent in these other instances was far clearer

Gronk is still on the roster but is deactivated for the game. BB then can either chose a player from the PS or activate a member of the 53 on gameday who otherwise would have been inactiveI prefer to think fairly about this whole thing. What Gronk did was wrong and he could have seriously injured the Bills' DB. IMHO, a fine commensurate with the offense and a one game suspension seems fair. If Goodell comes up with a multiple game suspension with an aim toward keeping Gronk out of the Steelers game, then I think the conspiracy theorists might have a leg to stand on. My one fear is that the suspension will be one game, the NFLPA or Patriots will appeal, and the appeal process will drag on until after the Miami game and be upheld for the Steelers game. I do have one question, if anyone knows the answer. When Gronk's suspension is enacted, do the Patriots get to fill his roster spot for that game or games? I think the answer is yes. If so, might BB activate Will Tye from the PS to fill out the TE slot? It would be good to see what he can do.

We can't sit back and "judge" what Gronk meant to do but only look at what he did.
