So if refs were told by Jez that Brady wants balls at 12.5 and Mac deflates them ....so that measurements are normal at halftime (with Ideal gas Law ) ....guess refs didnt follow Jez's instructions( added Air,why else would Mac have to deflate ?). Refs screwed up, thats where NFL should be checking. As well as why the refs didnt do job well with balls, being that it is soooooo important for integrity of game.

I would think the 5th amendment should apply in almost all situation, it is part of the Bill of Rights. The authors were adherents to the concept of Natural Rights, ie rights that are inherent to all humans. One cannot be compelled to incriminate oneself.

I thought that "I do not recall..." had become today's "I plead the 5th..." anyway. It offers the best of both worlds.
 
And remember – the release of the Testimony allows ALL of this relevant perspective on Goodell’s strategy out…

Capped off by the NFL filing to keep transcripts private and then leaking (via ESPN of course) that the NFLPA feared releasing the info (Didn't Stephen A. Smith say in an interview somewhere that his NFL sources said "bring it on!" when it came to releasing the testimony?)

And let’s also remember that Goodell was effectively called out for lying under oath in the Ray Rice VideoGate affair

You gotta wonder how many times Goodell gets to lie under oath and be caught scheming before the owners no longer feel he has “unquestioned integrity” and replace him per the NFL bylaws

Goodell works for 31 teams – as he himself said. How many owners are directly implicated in FrameGate?

How many owners were “generally aware” of what was going on?


Aside from that I'm having an increasingly difficult time believing that Judge Berman will use this case to showcase the nuances of law in which a clearly bogus frame job is affirmed on a legal technicality

I submit that Berman has shown himself interested in fostering justice - and avoiding cluttering up the legal system with crap like this from Goodell

Demonstrating justice for the watching public is the better choice for him while he's in this spotlight and I think he knows it. I'm not implying that Berman himself is a glory-hound... he just knows the judicial system itself is in the spotlight in a way.

I think he'll vacate this - the only question is how hard he slaps the NFL in his decision
 
Today on Twitter, Simmons complimented SI, PFT, and Yahoo sports for their coverage of deflategate. Subtle, Bill. No conspicuous omissions there.
 
Just a thought and probably of little relevance.

WE all KNOW (channeling my inner OTG here) the NFL* tried and convicted Brady in the court of public opinion and they were highly successful in doing so. we also know BRADY and his team remained very quiet and didn't offer much in the way of rebuttals (playing ot close to the vest so to say).

Does any of that provide a disadvantage for the NFL* or an advantage to Brady? I know Judge Berman is a single individual and the general answer will be open to his interpretation. But, are there any points to be won for Brady here?

We know Berman is a self proclaimed media junkie.
We know there was little information given about Brady and Berman (and us) have access to a significant amount of information previously unavailable. Does Berman have access to anything else (I doubt it) that we don't?
Is his curiosity similar to ours where we'd like to get the answer to some good and very obvious questions about how we got from 0 to .3PSI difference to the grand scheme to game the system (well that's what it is this week, next week who knows).

And for the life of me, I can't see why Goodell is taking such a firm stance. It would seem self destructive unless he is being directed to achieve the GOAL of allowing the NFL to be punitive in assigning blame/punishment. It just feels like there is a larger game being played here and I don't see how it benefits the game long term.

Just stop and think of ALL the various scandals he's been involved in... the talking heads who called him a liar, early on... ESPN cleared the ranks of any reporters who didn't care that ESPN pays the MOST for NFL game broadcast rights yet gets the LEAST bang for their buck

It was likely deemed a win win by ESPN higher ups to serve as Goodell's Propaganda network while getting all those juicy scoops

Too bad the Judge went and released the transcripts and the wheels fell off the Propaganda bus, illustrating that time after time after time ESPN was shown to be used by the NFL issuing false information

Both Goodell and ESPN are all in but depending on what Judge Berman says - and given the growing chorus of non-Patriots media talking heads pointing out the numerous lies of Goodell, I think the owners will begin to feel more heat (if we keep up the pressure on them) and ultimately decide to make Roger their sacrificial lamb to protect their own so-called "integrity"

I honestly think it may be too late - it would not surprise me if Berman comes down heavy on this abomination of justice and a farce of an independent investigation and impartial appeal and that reporters finally begin to ask WHY certain owners are in support of Goodell given that their own Article VIII says that ONLY a person of "unquestioned integrity shall be employed as Commissioner"

They base their prosecution of Brady on their Constitution, and Goodell's sweeping powers on Article VIII - but I think we continue a drum beat of citing the opening paragraph of that same Article and Constitution which CLEARLY states Goodell CANNOT remain as Commissioner given the proof of so many lies he's been caught in

In my opinion this all starts with Goodell being called out for lying under oath to a US District Court Judge for denying he knew Ray Rice assaulted his wife to be in that elevator - and the subsequent fallout including that over the 2 game suspension that had just 28% of NFL fans supporting him to continue as Commissioner and just 20% of women NFL fans backing him

This scandal was presented on a silver platter and Goodell, the old PR guru, saw a golden opportunity to ingratiate himself to 31 owners and fans of 31 teams

Unfortunately for him the truth has come out

I do believe his days are numbered - but only if the owners feel the pressure of fans holding the OWNERS responsible for the lack of integrity in the NFL offices

It is.

Although it could be argued that a Commissioner who can't possibly BE commissioner due to the NFL's own by-laws (Unquestioned Integrity - already shown to be a liar in court and is facing contempt of court charges), by the same token couldn't possibly be an impartial arbitrator.

It won't come to that, obviously, but it's an interesting theoretical argument.

If I'm not mistaken, the NFL cites the powers of the commissioner and Article VIII from which they're derived - specifically Article 8.3 - Jurisdiction to resolve disputes on page 28 (as well as conduct detrimental later)

Goodell and the owners are fond of citing 8.3 but have thus far overlooked 8.1

I don't think the phrase really applies to him. I have always heard it used as when something good became something bad. When something successful starts to fail.

Roger Goodell was never a talented, successful, intelligent commissioner making wise decisions in the first place.

I think were past that, we've moved on to TFBs lawyers submitting a motion in which they call the whole thing what it is ...a smear job. Nothing any one did or didn't do would have mattered. goodell was out to get brady, and thats that.

I think the most negative reports we heard did not truly catch fire until he released the appeal transcripts. He has the Well's report, and the transcripts in which Roger fraudulently mischaracterized Brady's testimony regarding speaking with JJ and his phone etc...,, so I think at a minimum he knows Roger will manipulate the truth.

He may or may not suspect Brady is not telling the truth but he knows Roger has not been honest throughout this process.
