@StephStradley well his first answer was really bad. He said its possible mcnally did to help brady. Why would he say that now?

.@SVN2010 No Kessler's answer wasn't bad. Reasonably acknowledged many multiple explanations for NFL *evidence.* Reasonable is persuasive.

This is so moronic....

Air leaks out of everything. Especially in the cold.

If you fill a ball up to the lowest possible allowed PSI (12.5) in a hot room, and then bring them outside where it's freezing cold and rainy, they're clearly going to leak.

Yet, we're in a federal court house.......seriously, I hope history brands this as the most moronic "scandal" of all-time. Goodell should have to serve time in jail for seriously wasting everyone's time and burning their brain cells. Unbelievable.

They don't "leak". Ifyou took said ball back to the hot room the PSI will go back up.

He was answering the question "why would someone do it without Brady's consent." That's all. he didn't say anyone actually did any tampering.

No need to overreact.

I was not aware that Kessler's answer was in response to that question... thanks for clearing that up

Yeah, I'm fine with this questioning. Assuming Brady's innocent, there should be a perfectly reasonable explanation that they're fine with laying out in court.
 
Kessler says Brady didn't turn them over on advice from Yee.
 
I would guess that he's leading to "even if you accept that the deflation happened as the NFL assumes, you still have little basis to assume that Brady was in on it". Ties back into Berman's argument that you have to show that Brady intended to be part of a conspiracy before you can punish him for it.

The fan in me wants him to lead with "there's no good evidence that deflation occurred in the first place", but there's a reason why Kessler gets paid a ton to do this and I'm just some guy on the internet.

Maybe the judge signaled that Goodell has a legal right to think McNally deflated footballs in the bathroom.

Not that he's CORRECT -- but that there's a enough basis that he gets to claim it, given the vast deference commonly accorded arbitrators and so on.

Oh really? So my cars tires just magically deflate when I leave it inside my driveway instead of my garage?

I guess Brady comes to my neighborhood and lets a little air out....

Kessler says Brady didn't cooperate out of privacy concerns.

And there it is. Given all of the leaks, in this case and all prior cases, it's going to be really hard for the NFL to go on the offensive about that. Also going to be hard for the NFL to argue against it given that "we didn't ask for his phone" is out of the picture. You can't claim in response to this that you didn't request his phone, while simultaneously using the fact that he wouldn't/couldn't produce his phone to infer guilt.
 
Kessler admits Brady "should have conducted himself differently with Wells".

They probably do leak, but not at a rate that would make any significant difference in this case.
