I'm not impressed, it sounds good, but sounds like he's going to grill the NFL and rip Goodell then say sorry Mr. Brady they followed the CBA, GFY. Hope I'm wrong but that is the vibe im getting.

I realize that one side getting grilled at a time is standard for these kinds of cases - and Berman will be devils advocate for Kessler too... it's still hard not to be a little more optimistic than I was earlier today.

Judges hate to be made to look like idiots. The last thing they want to do is condemn an innocent man. It is obvious that the NFL would not meet the guilty beyond a reasonable doubt threshold, and further, they can't even prove anything was done. Berman is pointing this out to the NFL. They also like it much better if the parties agree to a settlement so neither side will appeal the verdict. Seems like he is trying pretty hard to tell the NFL they have no case and they better settle or this is going to get ugly.

He should demand a concrete answer re: whether or not the report was independent.

Ultimately, that's a matter of semantics. More important to establish the facts around the question.

After it was delivered to the league office, and a member of said office confirmed by telephone that they'd received it, and an AP reporter published a recording of that confirmation.

Come on, man. There was an independent investigation done by someone that has made millions off of the NFL that found nobody in the NFL office ever said that.

That's the key question!!!

Was this only for one game (absurdly excessive punishment) or for a series of games (absurd lack of specificity about what the offense was, let alone evidence that it actually occurred)?
