Sorry but not filing an injunction seems like an awful idea especially since this whole thing started the NFL has been handing the pats their asses on every turn.

The NFL is either very confident or they have more on Brady they have yet to bring up that they plan on using in court. At this point I have lost all confidence in Brady not being suspended 4 games.

The NFLPA agreed and endorsed the motion.

If they felt that the motion was not in their best interest they would not have complied with the motion and pressed for the injunction.

Tanguay has weighed in. Brady has asked for an expedited process because there's no possible way he can win so he wants to get it over with and miss the first 4 games.

See...here's the good part. He's doing this so he doesn't miss games later in the season, yet if he knew he had a winning case, he'd get the TRO and then drag it out till the offseason. Easy peasy.

What I don't understand is why the NFLPA is skipping discovery unless they plan on using that for the defamation lawsuit.. I would think that Brady and the legal team would want to get ahold of EVERY single email, text, phone record, etc of what went on to show the malice the league had..

That was my reaction too.

I want Goodell, Kensil, Wells and the whole sick charade to be exposed and go down screaming for mercy, and if that means that the legal process goes on into the season, so be it.

But it sounds as though Kessler has told them they can win quickly and easily on the "law of the shop" argument -- that equipment violations aren't punishable by suspensions, that, anyway, the penalties are for the team, etc., etc. and that ole Rog is making it up as he goes along.

The other side's argument is that the penalty is for "conduct detrimental to the league". But none of the competent lawyers (e.g. Steph Stradley) think that that can be a catch-all for whatever Rog doesn't happen to like. But if Judge Berman doesn't agree, perhaps they can get into the wider due process issues (independence, objectivity, non-prejudgement of case, openness to evidence, etc.)

Meanwhile, it'd be nice if England slapped an embargo on the NFL until Goodell is REMOVED as commissioner. After all, it's the owners that WANT this expansion. Roger Goodell is just the two bit Park Ave. punk in the three piece suit who's acting as their rep. Besides, what true Englishman would ever want the ugliest of "ugly Americans" doing business on THEIR soil and braying out commands and orders like a stoned out Gen.Buck Turgidson straight out of Dr. Strangelove....?

The fantasy of deposing everyone in the NFL Offices seems to have hit that round porcelain bowl.. the good thing in a process such as this is it is short and sweet and they parties can only stick to the issues, the bad thing is we will never know what rat bastards Kensil, Goodell et al really are..

Funniest thing so far is Goodell asking for police protection from Pats Fans while vacationing in Maine, does anyone really believe that his $44 million dollar a year demagogue really believe he does not have his own security detail.. ??? Wallach mentioned on twitter that New York has a higher standard for granting am injunction than MN so the NFLPA probably didn't want to risk it and felt more confident about the actual ruling.

IIRC, he also said that overturning an arbitration award was easier in NY than in MN. Also keep in mind that either side has the option to appeal the judges decision after this, which may or may not include discovery.

What pisses me off the most is how this saga went from alleged balls deflation to cell phone destruction, to Tom Brady left defending himself as a lone scapegoat.

I know it's too late, I know hindsight is always 20/20, I know all about the shoulda/coulda/woulda I know it surly have already been said here, but I'll say it anyways, because it's the single biggest screw up this organization made:

This whole thing, Brady fighting for his reputation, the team's tarnished imagine, the penalties - it all could have been avoided had Kraft wasn't such a soft d1ckhead, and sued the league the VERY MOMENT those penalties were imposed. This would have gone to trial as the "New England Patriots vs. the NFL" case, in which the SINGLE MOST IMPORTANT piece would have been under scrutiny: the $hitty ***, biased, fully of horse$hit Wells report.

Instead of pouring over that lame POS report, and exposing it line by line, all the media is talking about nowadays is Brady's friggin cellphone!!!!

In that trial, the Wells report would have been exposed as one huge *** falsified hack job that would have been shredded to pieces. The Pats would have been exonerated, the penalties thrown out (including Brady's), and we wouldn't have been talking about cell phones, injunctions, settlements, etc. in the midst of training camp. Not only this whole saga would have been behind us, but we would have come up on top! Our brand name would have been cleared, and Goodell may have very well been out the door by now.

I know Kraft apologized on center stage, but his spineless decision not to fight the league just to appease the 31 other owners and the guy who was about to fck him in the *** (Goodell not exonerating Brady), just pisses me off to no end. To make matters worse, by accepting those penalties, he practically threw Tom Brady under the bus - the QB WHO BUILT YOUR LEGACY!! you fcking thankless POS!!!

There are certain outcomes and ramifications in life which no apology in the world can repair. In my eyes, Kraft is still a spineless ****y whose decision to bend the team over and have the league pound them in the *** for absolutely zero legal reason, cost their and TFB's reputation for good. Fcking IDIOT!!!

That's what I'm afraid of. That at a time when the pressure is finally rising on Goodell (owners have had enough of this fiasco) to settle this matter Tom and Co. turn around and make life much much easier on him.
